Witnessing the illegal leasing of 'golden land' that led to the prosecution of district leaders

TPO - Although the policy is to only lease business premises, officials of Krong Pac district, Dak Lak province, advised to lease land use rights, violating regulations. In connection with this violation, a former vice chairman of the district was prosecuted for investigation.

Dak Lak police are investigating violations in the lease of a 4,732 square ^meter plot of land in Krong Pac district.

Regarding this case, on June 6, the People's Procuracy of Krong Pac district approved the decision to prosecute Mr. Doan Xuan Binh - former Vice Chairman of the People's Committee of Krong Pac district and Mr. Phan Xuan Lam - Deputy Head of the Department of Agriculture and Environment of Krong Pac district. These two defendants are being investigated for the crime of "Violating regulations on land management".

According to the initial investigation results, in 2014, Ms. Le Thi To Kha (Krong Pac district) applied to rent a space in an empty lot at the beginning of Nguyen Thi Minh Khai street. The purpose was to build a complex of wedding restaurant, coffee shop, and karaoke.

After that, the People's Committee of Krong Pac district issued a decision approving the detailed construction plan 1/500 of Tan An Lake Central Park and announced the call for investment in the Tan An Lake Central Park project.

In June 2015, during the process of preparing the documents, Mr. Phan Xuan Lam - Deputy Head of the Department of Natural Resources and Environment (now the Department of Agriculture and Environment) of Krong Pac district - established, appraised, and advised Mr. Doan Xuan Binh to sign a lease for Ms. Le Thi To Kha of ^4,732m2 of land.

The district granted two land use right certificates in the Tan An lake area to Ms. Kha, which were not in accordance with the approved Land Use Plan for the period 2011-2020 and the first 5-year Land Use Plan (2011-2015) of Krong Pac district. This is contrary to the provisions of Article 52 of the 2013 Land Law.

The area for lease and land use rights granted in violation of regulations has been built with a massive structure.

As Tien Phong reported, in 2021, the Inspectorate of Krong Pac district issued conclusion No. 304, pointing out many violations in the leasing of the above land.

In 2014, the District Party Committee agreed in principle to let Ms. Le Thi To Kha rent more than ^4,700m2 for business purposes. However, the Department of Natural Resources and Environment advised the District People's Committee to grant Ms. Kha 2 Land Use Right Certificates, with a 50-year land lease term and annual land rent payment (VND 12,700/ ^m2 /year).

The inspector confirmed that the land belonged to the planning of Tan An Lake Central Park, and the leasing violated regulations. Checking the records, the authorities discovered that there was no document assessing the needs, no auction records were prepared, and the conclusion of the District Party Committee was not properly implemented.

According to the records, the land for lease is located in a prime location, right in the center of Phuoc An town (Krong Pac district). This place has been built with solid construction with a system of modern restaurants, cafes..., overlooking the lake. The number of visitors coming here is very high, especially during the holidays.
