More than 500 businesses discovered selling fake invoices

According to information released by the General Department of Taxation ( Ministry of Finance ) tonight, July 11, regarding the management of illegal invoices for tax evasion, in recent times, businesses have basically complied well with tax laws.

However, there are still some businesses that always try to cheat on taxes, buy and sell illegal invoices to evade taxes and appropriate tax refunds from the state budget.

The tax authority has coordinated with competent authorities to review and detect a number of subjects using fake ID cards/CCCDs to establish new or acquire inactive businesses to sell illegal invoices to businesses, reducing tax obligations to the state budget.

Through coordination with authorities, 524 enterprises were discovered selling illegal invoices and fake invoices (one of the prohibited acts stipulated in Clause 7, Article 6 of the Law on Tax Administration).

The case of 524 businesses selling invoices is different from the case of businesses selling goods and then abandoning the business address registered with the tax authority, because businesses selling invoices mainly falsely declare invoices for purchased goods.

The General Department of Taxation requests local tax departments to notify and invite businesses related to the 524 high-risk businesses mentioned above to prove that the use of invoices is legal. The business can explain directly to the tax authority or in writing.

The Law on Tax Administration stipulates the responsibilities and rights of taxpayers related to invoices as follows: In case the buyer of goods and services uses illegal invoices or documents and can prove that the violation of using illegal invoices belongs to the seller, he/she will be subject to administrative penalties for tax violations according to the provisions of Article 142 of the Law on Tax Administration. In case the taxpayer is found to use illegal invoices or illegally use invoices, he/she will be subject to administrative penalties for tax evasion according to the provisions of Article 143 of the Law on Tax Administration.
