Many policies to attract high-quality digital technology industry human resources

Article 19 on attracting high-quality digital technology industry human resources clearly states that high-quality digital technology industry human resources are Vietnamese people, Vietnamese people living abroad, and foreigners who meet the criteria prescribed by the Government .

High-quality digital technology industry human resources are foreigners who are granted temporary residence cards valid for 5 years and can be renewed according to the law on entry, exit, transit, and residence of foreigners in Vietnam.

Spouses and children under 18 years old of foreign high-quality digital technology industry human resources are granted temporary residence cards with a duration corresponding to the duration granted to high-quality digital technology industry human resources; local authorities and competent agencies create favorable conditions and support procedures when seeking jobs and enrolling and studying at educational and training institutions in Vietnam.

High-quality digital technology industry human resources enjoy personal income tax incentives according to the provisions of the law on personal income tax.

In addition, the Law also adds Clause 17 after Clause 16, Article 4 of the Law on Personal Income Tax, stipulating the exemption of personal income tax for 5 years for income including salaries and wages of high-quality digital technology industry human resources from the date of signing the first contract with Vietnamese agencies, organizations and individuals.

Tax-exempt income includes: income from digital technology industrial projects in concentrated digital technology zones; income from research and development projects, production of key digital technology products, semiconductor chips, artificial intelligence systems; income from training activities of digital technology industrial human resources.

Regarding the principles of developing, providing and deploying the use of artificial intelligence, the Law clearly stipulates that the development, provision and deployment of artificial intelligence must serve the prosperity and happiness of people, be people-centered, improve productivity and work efficiency, promote intelligence; have inclusive, flexible, fair and non-discriminatory access; respect ethical and national values; human rights, civil rights, rights and legitimate interests of organizations and individuals.

At the same time, it is necessary to ensure transparency, accountability, and explainability; ensure that it does not exceed human control; ensure network safety and security; ensure compliance with legal regulations on data and personal data protection; ensure the ability to control algorithms and artificial intelligence models; control risks throughout the life cycle of artificial intelligence systems; ensure compliance with laws on consumer protection and other relevant laws.

The Law on Digital Technology Industry takes effect from January 1, 2026. Some regulations on finance for digital technology industry development; investment support and incentives for manufacturing digital technology products and services; and support for innovative start-up projects in the digital technology industry take effect from July 1, 2025.
