Regarding the specific content, delegate Thu said that the number of human trafficking crimes tends to increase every year, especially the situation of buying and selling fetuses and men for forced labor on fishing boats. In some places, the situation of buying and selling newborn babies has emerged under the guise of a sophisticated organization under the name of spontaneous charity. "Buying and selling fetuses in the womb is an act that violates morality and good customs. Therefore, it is necessary to supplement regulations on criminal prosecution in the buying and selling of fetuses," the delegate from Thai Binh emphasized. Regarding specific regulations on specialized facilities to support victims of human trafficking for men and women, delegate Tran Khanh Thu said that social protection facilities that receive victims of human trafficking do not have specialized areas to support victims of human trafficking, but are integrated with other groups of subjects. Therefore, it is difficult to implement support work because there is no appropriate and friendly process for receiving victims, there is a lack of regulations on case management and specific victim support processes; especially there is a complete lack of regulations on receiving in emergency cases or suspected of being trafficked while waiting for verification and identification of victims. The form of buying and selling fetuses in the womb is complicated . Delegate Huynh Thi Phuc ( Ba Ria - Vung Tau ) also proposed that the draft law consider adjusting new behaviors arising in practice regarding human trafficking. According to the delegate, a new behavior has appeared in social life, which is the sale of fetuses in the womb. The buying and selling of fetuses begins from the time of pregnancy until the child is not yet born, so there are no consequences, leading to difficulties in handling. "According to the current criminal law of our country, a child is only considered a person and has civil rights when born, but when still a fetus in the mother's womb, it has not been adjusted to be considered the subject of a crime. Therefore, the authorities do not have the basis or legal basis to handle the act of buying and selling fetuses," said the delegate.

Delegate Phuc said that, from a legal perspective, the act of a mother who has a child and then sells it is also an act that must be defined as human trafficking and has signs of committing the crime of human trafficking. However, in reality, the current law has not yet regulated it, so there is no basis for consideration. The 2015 Penal Code as well as the law on preventing and combating human trafficking also have no regulations on the above issue. Therefore, the delegate said that in this amendment to the Law, the Drafting Committee needs to consider and consider finding appropriate solutions for the act of buying and selling fetuses in the womb in the face of the increasingly complex and sophisticated situation of buying and selling fetuses in the current period. On the other hand, currently, the subjects who commit human trafficking are concealed by very complicated forms such as sightseeing tours, signing economic contracts, exporting labor, organizing marriages through brokers, adopting children through commercial legal entities, etc. Therefore, the delegate proposed that it is necessary to consider and consider adding the subject of criminal responsibility as a commercial legal entity for the crime of human trafficking. From there, it will help to promptly adjust to the reality of the current situation of human trafficking with a tight, multinational organizational structure.
