My Dinh Sports Complex in court for the second time

According to the latest announcement, the next trial will take place on July 17, 2023 with the defendant being the My Dinh National Sports Complex (the complex) and the plaintiff being Hai Yen Company. This company sued the complex for breach of contract signed in 2011 - the time when Mr. Can Van Nghia was the director of the complex (he retired in 2018, and then the Government Inspectorate in the inspection document on public asset management at the complex concluded that there were signs of violations).

According to the 10-year contract (from December 2011 to December 2021), Hai Yen Company rented the premises for business purposes. In 2019, the complex unilaterally terminated the contract and reclaimed the premises to serve the construction of a Formula 1 racing track (the race was later canceled in Vietnam). Without negotiation, direct communication, or written notice, the complex cut off electricity and water at the restaurant owned by Hai Yen Company. The company sued the complex for compensation of 20 billion VND, because after the electricity and water were cut off, the restaurant had no customers, leading to a heavy loss of up to 30 billion VND.

Although he did not sign a contract or "order" the power and water to be cut off at Hai Yen Company's restaurant, because he is the current director, Mr. Nguyen Trong Ho (Mr. Ho has held this position since 2020) became the defendant's representative and had to appear in court. At the trial last October, Mr. Ho did not accept the content of Hai Yen Company's lawsuit. The defendant requested that the plaintiff must have records and books to prove the times the power and water were cut off. After hearing the opinions of the plaintiff and the defendant, the court temporarily adjourned the trial and requested the parties to provide additional relevant documents and evidence.

Sharing with Thanh Nien , the leader of the complex said: "We are not too worried about this case and are waiting for the court's wise verdict. The bigger worry is that the complex is currently in huge tax debt and will soon continue to receive official dispatches from the tax authority regarding the enforcement of invoices against the unit. We really hope that the relevant ministries and branches will soon come up with a solution to solve the problem for the complex."
