Bringing the Law on Teachers into Life: Strengthening Inter-sectoral Coordination

According to Ms. Nguyen Thi Viet Nga - National Assembly Delegation of Hai Phong City, the qualityof education is determined by the teaching staff. Therefore, if the salary is low, it will be difficult to attract talented people and good students will not be interested in the teaching profession. When we cannot attract good people, we cannot have high-quality human resources for the education sector.

On the contrary, when teachers' salaries are ranked at the highest level in the administrative career salary scale, it will be a breakthrough policy to attract excellent students to pedagogical schools. Similar to the medical sector, because of the great interest of society, the benchmark is always high; thereby filtering out the best people. When there is good input, we will have good output and a team of good teachers.

Therefore, Ms. Nguyen Thi Viet Nga believes that when teachers' salaries are improved, two goals will be achieved: Retaining competent people and attracting new talent. "To do so, there needs to be smooth coordination between ministries, branches, relevant agencies and localities so that the Law on Teachers can soon come into effect and promote its effectiveness, efficiency and value in practice," Ms. Nguyen Thi Viet Nga stated her opinion.

Believing that the policies of the Law on Teachers will soon come into effect, National Assembly delegate Ho Thi Minh (Quang Tri province delegation) said that in order for the policies of the law to soon be effective in practice, the Government needs to direct relevant ministries and branches such as the Ministry of Finance, the Ministry of Home Affairs, etc. to closely coordinate with the Ministry of Education and Training to provide specific instructions; above all, ensure resources and allocate budget to be able to implement policies on salaries and other benefits immediately after the law comes into effect.

“The effectiveness of the Law on Teachers does not only depend on its content but also on its implementation in practice. In that spirit, localities need to be transparent in paying allowances and preferential policies for teachers to ensure the law’s effectiveness and efficiency, and promote its humanistic values,” delegate Ho Thi Minh suggested.

Policy details

According to Mr. Le Trong Vinh - former Deputy Director of the Legal Department ( Ministry of Home Affairs ), there are many contents related to other specialized laws and decrees such as: Law on Government Organization, Law on Organization of Local Government, Law on Civil Servants, Labor Code, Law on Social Insurance, Law on Education, Law on Vocational Education, Law on Higher Education... This is a difficult issue, so some articles are assigned to the Government for detailed regulations.

Therefore, it is necessary to review current documents to avoid duplication when there are new instructions on law implementation. In addition, it is necessary to promote decentralization and maximum delegation of power in education management; clearly define the responsibilities of each agency and level and design tools to strengthen supervision, inspection and control of power; strengthen public-private cooperation in teacher training; facilitate teachers to practice within the legal framework. Along with that, it is necessary to minimize administrative procedures, eliminate the mechanism of asking for and giving, reduce compliance costs and inconvenience for people, organizations and teachers...

When drafting the Law on Teachers, Mr. Vu Minh Duc - Director of the Department of Teachers and Educational Managers (Ministry of Education and Training) shared that the drafting agency wanted to concretize the Party and State's policies into the law.

Accordingly, point b, clause 1, Article 23 stipulates: "Teachers' salaries are ranked highest in the administrative career salary scale system". Mr. Vu Minh Duc emphasized: This is an important basis for the Government to have regulations related to teachers' salaries to ensure the policy of 'ranking highest'.

The Director of the Department of Teachers and Educational Managers said that in the draft Decree regulating salary policies, allowances, support and attraction regimes for teachers in the draft Law on Teachers, the Ministry of Education and Training has advised the Government to rearrange the salary tables of a number of teacher positions (such as preschool teachers, general education teachers, university preparatory teachers, vocational education teachers grade IV...) to ensure consistency in the salary tables applied to professional positions of teachers and civil servants in other sectors and fields;

At the same time, it ensures the living standards of teachers, helping teachers feel secure in their work and contribute to the education cause. The draft Decree also stipulates a special salary coefficient for teachers at a level from 1.1 to 1.6 depending on the level of education and training, ensuring that teachers' salaries are higher than those of civil servants on the same salary scale applied in other sectors and fields; reducing the salary gap between young teachers and experienced teachers in the same job position.

These proposed solutions are implemented in the context of salary payment being implemented according to the provisions of Decree No. 204/2004/ND-CP of the Government and will be the basis for salary rearrangement when the Government issues a new salary policy to ensure that teachers' salaries are "ranked highest".

The above provisions in the Law on Teachers are an important legal basis for the Ministry of Education and Training to issue under its authority or advise the Government to issue specific regulations and guidelines to implement salary policies and preferential regimes for teachers, demonstrating the respect of society and the care of the Party and State for the teaching staff. - Mr. Vu Minh Duc - Director of the Department of Teachers and Educational Managers (Ministry of Education and Training)
