Conditions for transferring common industrial solid waste

(Chinhphu.vn) - Mr. Vu Duy Dai's company (Ninh Binh) has a need to transfer pig waste after drying (using a drying machine and is pre-processed common industrial solid waste) to an organic fertilizer production unit.

Mr. Dai asked, is his company allowed to transfer pig waste to the organic fertilizer production unit above? If so, what does the company need to do to ensure compliance with the legal requirements on waste management?

The Ministry of Agriculture and Environment responded to this issue as follows:

Pursuant to Clause 2, Article 66 of Decree No. 08/2022/ND-CP dated January 10, 2022 of the Government detailing a number of articles of the Law on Environmental Protection, the owner of a source of ordinary industrial solid waste transfers ordinary industrial solid waste according to the provisions of Clause 1, Article 82 of the Law on Environmental Protection; is allowed to transfer ordinary industrial solid waste prescribed in Clause 1, Article 65 of this Decree after classifying it in accordance with regulations to organizations and individuals in need.

In case the facility is subject to environmental license, it must submit an application for environmental license according to the provisions of Article 29 of Decree No. 08/2022/ND-CP (amended and supplemented in Decree No. 05/2025/ND-CP).
