At the press conference providing information on the socio -economic situation in Ho Chi Minh City on the afternoon of July 31, Mr. Than Vinh Long, Deputy Head of the Urban Development Department (Ho Chi Minh City Department of Construction) informed about households and shops that have paid fees to temporarily use part of the roadway and sidewalk according to Decision 32/2023 of the Ho Chi Minh City People's Committee.

Accordingly, service businesses and goods trading on the sidewalk that have paid fees will be maintained until the end of the fee payment period, and the city will not consider approving a new location.
According to Mr. Than Vinh Long, after the National Assembly promulgated the Road Law and the Law on Road Traffic Order and Safety, on December 26, 2024, the Government issued Decree 165/2024 detailing and guiding the implementation of the Road Law and Article 77 of the Law on Road Traffic Order and Safety. These regulations take effect from January 1, 2025, abolishing the 2008 Road Traffic Law, and adjusting many contents in the management and use of roads and sidewalks. Therefore, Decision 32 of the Ho Chi Minh City People's Committee is no longer appropriate.
In order for the management of roads and sidewalks in Ho Chi Minh City to be consistent with the new regulations that will take effect from 2025 as mentioned above, as well as in line with the practical situation and needs of the people, the Department of Construction has proposed and received approval from the Ho Chi Minh City People's Committee to abolish Decision 32; proposed the Ho Chi Minh City People's Council to consider amending and supplementing Resolution 15/2023/NQ-HDND on the fee collection for temporary use of roads and sidewalks in Ho Chi Minh City.

The Department of Construction also proposed that the Ho Chi Minh City People's Committee approve the assignment of the Department to coordinate with the Ho Chi Minh City Institute for Research and Development to develop a project on management, exploitation and use of roads and sidewalks in Ho Chi Minh City. This project is built on the basis of the Law on Management and Use of Public Assets. It includes collecting relevant information and projects in Binh Duong and Ba Ria - Vung Tau provinces (formerly) to serve as a basis for implementation throughout Ho Chi Minh City. The project includes many activities, including service business and buying and selling goods on sidewalks.
“If approved by the Ho Chi Minh City People's Committee, the Department of Construction will coordinate with relevant units to develop and complete the project within 12 months and organize a pilot project in some central wards, areas, and roads with roadsides and sidewalks that ensure width, are suitable for reality, traffic needs, development, economy, tourism, etc. and organize an assessment before expanding the scope,” Mr. Than Vinh Long informed.
