Dam Vinh Hung 'accuses' singer Bich Tuyen and her husband of 'deception and psychological manipulation'

In the latest development, singer Dam Vinh Hung submitted a 15-page affidavit to the California Superior Court, Orange County.

Because the defendant - Mr. Gerard Richard Williams requested the Court to accept his application to withdraw the lawsuit in November 2024, Dam Vinh Hung submitted an affidavit to protest this.

According to the document, after being sued by Dam Vinh Hung in October 2024, Gerard and Bich Tuyen invited him to meet at a restaurant in the US and then suddenly made up an excuse, forcing him to come to their home to discuss the details.

Here, Dam Vinh Hung was suddenly threatened by Gerard and Bich Tuyen in many different ways, from reporting him to the Tax Department, Immigration Department to defamation on social networks, even targeting his mother and son.

Out of concern, the singer agreed to suspend the lawsuit to resolve the matter internally. With limited English and no legal knowledge, he had to rely on translation tools and artificial intelligence to communicate with the lawyer.

According to Bich Tuyen, Dam Vinh Hung used the sample content she wrote to send to the lawyer. He was sure that the email was a request to "suspend" (stay) the lawsuit, not knowing that Bich Tuyen had added the phrase "with prejudice" - meaning to suspend the lawsuit with permanent effect.

In the American judicial system, the term "dismissal with prejudice" refers to the final dismissal of a lawsuit, which results in the case ending permanently and the plaintiff cannot re-file a lawsuit on the same issue.

In contrast, "dismissal without prejudice" results in the case not being completely closed, and the plaintiff can re-file the lawsuit later if he or she wishes.

Dam Vinh Hung affirmed that he never intended to give up his right to sue Gerard and Bich Tuyen. The two sides have never reached any agreement or settlement and he is still suffering the consequences of the accident involving them.

The singer believes that the defendant couple intentionally deceived and manipulated him psychologically to escape the lawsuit without compensation or negotiation.

Therefore, he requested the Court to reject the defendant's request and continue the lawsuit so that he could protect his legitimate rights.

Attached to the affidavit are a series of photos of Facebook messages between Dam Vinh Hung, Bich Tuyen and several related people.

According to the reporter's observation, these text messages show that Bich Tuyen persuaded and sent sample content with details of "decision to cancel the prejudiced lawsuit, effective immediately" to Dam Vinh Hung.

On the website of the Orange County Superior Court of California, the pre-trial hearing of the case will take place on July 7; the official hearing will be on September 22.
