The first night market using mixed-use land: Making the most of land resources

In recent times, Cam Lam - Cam Ranh night market (in Thuy Trieu village, Cam Hai Dong commune, Cam Lam district) has attracted a large number of people and tourists to have fun, shop, and enjoy local seafood dishes. This is the first night market in the province to use multi-purpose land according to the provisions of Article 218 of the 2024 Land Law and the decree guiding its implementation; contributing to promoting land value, while creating revenue for the state budget.

The location of Cam Lam - Cam Ranh night market is on plot 626, with an area of ​​9,860m2 , production forest land type (belonging to the agricultural land group), land use term until January 1, 2057. The plot of land is located in an area stuck in "suspended planning" since 2003 until now. Due to not attracting investors, the land in this area has been left vacant, fallow, causing waste of land resources. Since the 2024 Land Law took effect (August 1, 2024) with regulations on multi-purpose land use, it has removed the "bottleneck" for areas of agricultural land with ineffective production, no income from agricultural production, which can be used in combination with commercial and service purposes. Thereby, helping to unblock land resources, land users can promote land value, creating revenue for the state budget.

After receiving the land use dossier combined with commercial service purposes of the land user, the Department of Agriculture and Environment of Cam Lam district assessed and showed that the current status of the land is vacant, with grass, thorns, and no crops on the land; the area of ​​agricultural land combined with multi-purpose land forms a night market with 6 areas of prefabricated iron frame construction and cement floor with a total area used for commercial service purposes of 3,000m2 , accounting for 30.42% of the total land area; The kiosks are built with a prefabricated steel frame structure, mixed wood walls, corrugated iron and thatched roofs, installed without being connected to the foundation, so they can be easily dismantled and relocated, ensuring compliance with Article 99, Decree No. 102 of the Government detailing the implementation of a number of articles of the Land Law in 2024. On March 25, Cam Lam District People's Committee approved the Plan to use agricultural land in combination with commercial and service purposes according to the above plan; the usage period is 36 months, ensuring compliance with current legal regulations.

Speaking to reporters, Mr. Huynh Uy Vien - Vice Chairman of Cam Lam District People's Committee said that this is the first night market on agricultural land used in combination with commercial and service purposes according to the 2024 Land Law. Therefore, in addition to meeting the regulations on land, the district has also directed specialized units and Cam Hai Dong Commune People's Committee to regularly inspect and supervise night market activities to ensure compliance with legal regulations on construction, environment and business.

Article 218 of the 2024 Land Law stipulates: “The following types of land are used for multiple purposes: Agricultural land is used for commercial purposes, services, animal husbandry, and medicinal plant cultivation; land used for public purposes is used for commercial purposes, services; land for construction of public works is used for commercial purposes, services…”.

Along with that, the District People's Committee requires land users to properly implement the contents and items according to the provisions of the law on construction and the plan for using agricultural land in combination with commercial and service purposes approved by the District People's Committee; fulfill financial obligations according to regulations; properly implement commitments and related measures to ensure that national defense and security are not affected; ensure environmental sanitation, fire prevention and fighting, food safety and security and order according to the provisions of law... In case the State reclaims land for national defense and security purposes and for socio -economic development for national and public interests, land users must dismantle and relocate constructions on the land and will not be compensated for constructions according to the approved plan. When the land use term for combined purposes expires without being extended, the land user is responsible for restoring it to meet the conditions for using the land for the main purpose according to the land use right certificate.
