6 teachers fired and court decision

The incident originated in March 2018, when the People's Committee of Krong Pak district issued a notice forcing 550 contract teachers to quit their jobs because they were recruited beyond the staffing quota.

After that, 5 former teachers at Nguyen Thi Minh Khai Secondary School filed a lawsuit, protesting the above decision and authorized Mr. Nguyen Anh Duong as the legal representative. In June 2022, the Dak Lak Provincial People's Court continued to declare that Nguyen Thi Minh Khai Secondary School lost the lawsuit and the People's Committee of Krong Pak District had to jointly compensate nearly 1.3 billion VND to 5 teachers for their fault in unilaterally terminating the labor contract.

In addition, teacher Nguyen Thi Binh - former teacher of Ea Kly Secondary School also filed a lawsuit with the same content. In April 2022, Dak Lak Provincial People's Court declared that Ea Kly Secondary School lost the lawsuit and the People's Committee of Krong Pak District must jointly be responsible for compensating Ms. Nguyen Thi Binh more than 175 million VND for her fault in unilaterally terminating the labor contract.

In October 2023, the People's Committee of Krong Pak district submitted a request to the People's Committee of Dak Lak province and the Department of Finance to request an additional amount of more than 2.1 billion VND (including interest) to pay for 6 teachers, but it was not approved.

Teacher Nguyen Anh Duong (representing the teachers) said that the district People's Committee's delay in executing the verdict greatly affected the lives of the 6 teachers.

According to Mr. Anh Duong, since leaving the podium until now, all 6 teachers have had to do many jobs to make a living such as selling coffee, welding...

"We are all facing many difficulties in life. We are also looking forward to the above compensation to cover and take care of our families," said Mr. Anh Duong.

Dak Lak Provincial People's Committee is considering

Recently, on May 30, the People's Committee of Krong Pak district reported on the implementation of the obligation to execute the judgment to compensate 6 contract teachers who were fired.

The content of the submission clearly states that the Dak Lak Provincial People's Committee agrees in principle to use the 2025 budget capital of the Krong Pak District People's Committee to carry out compensation in the above two judgments and other expenses, if any.

In addition, the People's Committee of Krong Pak district also requested the Standing Committee of the District Party Committee to report and ask for direction from the Standing Committee of the Provincial Party Committee to direct the inspection and clarification of organizations and individuals who violated the law and caused damage in the incident, and handle them according to the provisions of law.

Regarding this, speaking with VietNamNet reporter on the morning of June 24, Mr. Nguyen Thien Van, acting Chairman of Dak Lak Provincial People's Committee, said that he had received information that the People's Committee of Krong Pak district asked for opinions on the policy of using the district's budget to compensate 6 teachers.

According to Mr. Van, this matter must be reported to the Provincial Party Committee Standing Committee for consideration, and furthermore, using the budget to compensate the above teachers is not an exceptional case.

"The province only agrees to report to the Provincial Party Committee Standing Committee, but the level that does it must take responsibility, must determine the responsibility of the organization and individual, and the regime must be paid for," Mr. Van stated his opinion.

A leader of the People's Committee of Krong Pak district informed that the Standing Committee of the District Party Committee had sent a document asking for opinions from the Standing Committee of the Provincial Party Committee but had not received any response.

"When the Provincial Party Standing Committee agrees on the policy but there is no longer a district level, it will be brought back to the commune level for handling," this leader affirmed.

Despite winning a lawsuit 3 years ago in a case of illegal termination of labor contracts, 6 teachers in Krong Pak district (Dak Lak) still have not received compensation.
