Private school in Dak Lak has not been converted to private for 12 years: Province issues 'urgent' directive

On June 21, the acting Chairman of the Dak Lak Provincial People's Committee - Mr. Nguyen Thien Van signed an official dispatch on converting the school type of Nguyen Binh Khiem Private Primary School (Nguyen Binh Khiem School) to private.

According to this document, on June 19, the Provincial People's Committee received a document from the People's Committee of Buon Ma Thuot City regarding some difficulties in converting the type of Nguyen Binh Khiem School from public to private.

The provincial People's Committee leader said that the difficulties of Buon Ma Thuot City have been answered in many documents. The provincial People's Committee has assigned the city to proactively coordinate with departments and branches to completely resolve the problems in the documents and procedures for converting the type of Nguyen Binh Khiem School and has repeatedly urged this matter.

In Official Dispatch No. 2667 dated May 19, 2025, Buon Ma Thuot City People's Committee no longer reported difficulties and problems and requested the Provincial People's Committee to extend the deadline to May 30, 2025.

However, when the deadline (June 30, 2025) for converting school types according to Circular No. 16/2023 of the Ministry of Education and Training is about to expire, the People's Committee of Buon Ma Thuot City continues to report difficulties and problems to the Provincial People's Committee.

The leaders of the Provincial People's Committee requested Buon Ma Thuot City to proactively and seriously work with relevant departments, branches and units to resolve difficulties and problems and complete the conversion of school types before June 30, 2025.

The Provincial People's Committee also severely criticized the delay of Buon Ma Thuot City, requesting clarification of the responsibilities of individuals involved in this delay.

In case the deadline of June 30, 2025 is exceeded, the People's Committee of Buon Ma Thuot City does not complete, the collective and individuals involved will be responsible before the law and the Provincial People's Committee.

The 12-year school has yet to be converted to private.

Regarding the change of school type for Nguyen Binh Khiem School, Tien Phong newspaper published an article reflecting that a private school in Dak Lak has struggled for 12 years but still has not been converted to private.

According to records, Nguyen Binh Khiem School originated from Le Hong Phong Primary School, located in Buon Ma Thuot town (now city), established in 1992.

At that time, the City Youth Union (now the City Youth Union) of Buon Ma Thuot applied to open a private school, so this organization was the Chairman of the Board of Directors.

In 1997, the Departmentof Education and Training of Dak Lak province appointed Mr. Nguyen Dinh Long as Principal of Nguyen Binh Khiem School. Also in this year, the People's Committee of Dak Lak province decided to lease 4,815m² of land to build the school.

According to the decision of the Provincial People's Committee, Nguyen Binh Khiem School has a total investment of more than 3.5 billion VND. Dak Lak province supports 140 million VND, the construction cost comes from the school's own capital, bank loans, and shares. The investor is the Chairman of the Board of Directors.

After the decision, Buon Ma Thuot City Youth Union assigned Principal Nguyen Dinh Long to mobilize capital to build the school and organize activities according to the regulations of the Ministry of Education and Training.

In 2001, the Ministry of Education and Training issued Decision No. 39 regulating the organization and operation of non-public schools. According to this regulation, Nguyen Binh Khiem School is eligible to become private.

In 2013, Buon Ma Thuot City People's Committee requested Nguyen Binh Khiem School to prepare a dossier to convert the school type according to Circular No. 11/2009 of the Ministry of Education and Training.

However, after this school submitted its application and conversion plan, the People's Committee of Buon Ma Thuot City repeatedly requested additional documents. Because the time limit for converting the model was almost over and the competent authority had not yet agreed, in 2024, Nguyen Binh Khiem School sued the People's Committee of Buon Ma Thuot City.

According to judgment No. 37/2025, Buon Ma Thuot City People's Committee violated the law by not converting the type of Nguyen Binh Khiem School and must comply with regulations.
