5 Decrees guiding the Law on Management and Use of State Capital Invested in Enterprises continue to take effect

The Government has just issued Resolution No. 253/NQ-CP dated August 26, 2025 on promulgating the Government's Decrees guiding the implementation of the Law on Management and Use of State Capital Invested in Production and Business at Enterprises (Law No. 69/2014/QH13) which continues to be effective.

The Resolution clearly states that the legal documents issued by the Government detailing specific measures to organize and guide the implementation of the Law on Management and Use of State Capital Invested in Production and Business at Enterprises (Law No. 69/2014/QH13) will continue to be effective from August 1, 2025 until there is a replacement or repeal document, including:

1- Decree No. 87/2015/ND-CP dated October 6, 2015 of the Government on supervision of state capital investment in enterprises; financial supervision, performance evaluation and disclosure of financial information of state-owned enterprises and enterprises with state capital.

2- Decree No. 126/2017/ND-CP dated November 16, 2017 of the Government on converting state-owned enterprises and single-member limited liability companies with 100% charter capital invested by state-owned enterprises into joint stock companies (amended and supplemented by Decree No. 140/2020/ND-CP dated November 30, 2020 of the Government).

3- Decree No. 23/2022/ND-CP dated April 5, 2022 of the Government on establishment, reorganization, ownership conversion, and transfer of ownership representation rights at enterprises in which the State holds 100% of charter capital.

4- Decree No. 91/2015/ND-CP dated October 13, 2015 of the Government on state capital investment in enterprises and management and use of capital and assets at enterprises (amended and supplemented by Decree No. 32/2018/ND-CP dated March 8, 2018; No. 121/2020/ND-CP dated October 9, 2020; No. 140/2020/ND-CP dated November 30, 2020 and No. 167/2024/ND-CP dated December 26, 2024 of the Government).

5- Decree No. 10/2019/ND-CP dated January 30, 2019 of the Government on the implementation of rights and responsibilities of state owner representatives (amended and supplemented by Decree No. 97/2024/ND-CP dated July 25, 2024 of the Government).

The application of Law No. 68/2025/QH15 and legal documents prescribed in Article 1 of this Resolution shall be implemented in accordance with the provisions of Clause 3, Article 58 of the Law on Promulgation of Legal Documents 2025 (in case legal documents have different provisions on the same issue, the document with higher legal effect shall apply).
