Prosecution of defendant Tran Dinh Trien for the crime of abusing freedom to infringe upon the interests of the State

The Supreme People's Procuracy has issued an indictment to prosecute defendant Tran Dinh Trien (born in 1959, practicing lawyer, Head of the For the People Law Office, Hanoi Bar Association) for the crime of "Abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals" as prescribed in Article 331, Clause 2 - Penal Code.

The Procuracy has transferred the case file to the Hanoi People's Court for study and consideration for first instance trial.

According to the indictment, on February 3, 2013, defendant Tran Dinh Trien created an account on the social networking site Facebook under the name "Tran Dinh Trien," registering with the information of Lawyer Tran Dinh Trien, Head of the Vi Dan Law Office.

This Facebook account is only managed and used by the defendant Tran Dinh Trien, and does not share administrative rights with anyone else.

During his practice as a lawyer, defendant Tran Dinh Trien developed personal resentment, believing that the Court sector and the leadership of the Supreme People's Court had unreasonable issues.

Therefore, between April 23, 2024 and May 9, 2024, the defendant drafted and used the Facebook application installed on his personal mobile phone to post 3 articles on the Facebook page "Tran Dinh Trien."

The expert conclusion determined: The posted information had content that affected the reputation and honor, and infringed upon the legitimate rights and interests of the People's Court system and the individual leaders of the Supreme People's Court. This had a negative impact on security, order, and social safety.

At the investigation agency, defendant Tran Dinh Trien stated: The information and content stated in the above articles were collected, commented on, and evaluated by the defendant based on his subjective opinion about the Court sector and the individual leaders of the Supreme People's Court without any authentic information, documents, or evidence to verify.

During the investigation of the case, Ms. Mai Thi H (born in 1961, residing in Ham Yen district, Tuyen Quang province) filed a complaint against defendant Tran Dinh Trien for "Abuse of trust to appropriate property" in the implementation of a legal service contract between the Vi Dan Law Office, headed by defendant Tran Dinh Trien, and Ms. H.

Working with the Ministry of Public Security's Investigation Security Agency, Ms. H realized that the agreement and implementation of the Legal Service Contract between her and the Vi Dan Law Office of defendant Tran Dinh Trien was a civil relationship, so she submitted a request to withdraw the content of the accusation against defendant Trien.
