Establish a fund to support defense policy and foreign affairs activities.

According to the Decree, the Defense Foreign Policy Fund is a non-budgetary state financial fund, has legal status, its own seal and is allowed to open an account at a commercial bank legally operating in Vietnam.

The Government establishes the Defense Foreign Policy Fund according to regulations.

The Fund is located at the Ministry of National Defense . The Minister of National Defense decides on the organization and management mechanism, and issues the Regulations on the organization and operation of the Fund according to the provisions of this Decree.

The Decree clearly states that the state budget does not support the fund's operating costs. The management and use of the fund must be for the right purpose, in accordance with the law, timely, effective, public and transparent.

One of the fund's operating principles is not to accept contributions, sponsorships, or support that harm national interests, security, defense, violate laws on anti-corruption, money laundering, terrorist financing, and other activities that are contrary to the law.

At the same time, the fund also does not support organizations and individuals who conduct illegal activities contrary to the provisions of Vietnamese law.

Support for defense policy and foreign affairs activities that the state budget has not yet guaranteed.

According to the Decree, the fund receives, manages, and uses contributions, sponsorships, and support in cash and in kind from businesses, organizations, and individuals inside and outside the military to carry out defense policy and foreign affairs work.

The Fund is responsible for supporting defense policy and foreign affairs activities that the state budget has not yet guaranteed or has guaranteed but has not yet met practical requirements.

At the same time, the fund must implement the reporting and accounting regime in accordance with the provisions of this Decree and other relevant legal provisions; comply with inspection, examination and audit by competent state agencies in accordance with the provisions of law.

The fund is allowed to use its idle operating budget to deposit term deposits of no more than 12 months at commercial banks in order to increase the fund's operating budget.

The Chairman of the Fund is appointed and dismissed by the Minister of National Defense.

The Decree clearly states that the Fund Management Board consists of a Chairman, Vice Chairman and members.

The Chairman of the Fund is appointed and dismissed by the Minister of National Defense; the number of Vice Chairmen and members is decided by the Minister of National Defense, appointed and dismissed upon the proposal of the Chairman of the Fund.

The standing body managing the fund is appointed by the Minister of National Defense.

The tasks, powers and working regime of the Management Board and the standing body of the fund are prescribed by the Minister of National Defense.

Sources of fund formation and procedures for receiving contributions, support and sponsorship

According to the Decree, the fund is formed from contributions, support, and sponsorship in cash, assets, and in-kind from organizations, individuals, and businesses inside and outside the Army; revenue from deposit interest; other sources of contributions, support, sponsorship, and other revenues as prescribed by law.

The above financial resources are received at the fund management agency directly or through an account opened at a bank according to regulations.

In case of receiving contributions, support, and sponsorship in cash: the fund shall receive directly in cash or through the fund's account opened at a commercial bank legally operating in Vietnam.

In case of receiving contributions, support, and sponsorship in the form of assets or objects: the fund shall receive them directly at the fund management agency or at a location agreed upon between the fund and the contributor, supporter, or sponsor.

The value of received contributions, support, and sponsorship in the form of assets and objects is converted into Vietnamese Dong and recorded in the contribution, support, and sponsorship records.

For the form of construction funding, the appraisal and approval of technical design and total estimate, issuance of construction permits, construction quality management, acceptance, handover, warranty and construction insurance are carried out in accordance with current regulations of law on construction investment.

Fund expenditure content

The fund is spent on policy subjects and policy programs that have been approved by the Party, the State or by the decision of the Minister of National Defense; spending to support the work of overcoming the consequences of natural disasters and epidemics; search and rescue work; spending to support forces under the Ministry of National Defense in performing military and defense tasks; spending to support the embellishment, restoration and renovation of cultural works and historical relics associated with the nation's revolutions; martyrs' cemeteries.

In addition, the fund is spent on defense foreign affairs activities of the Ministry of National Defense or foreign affairs activities according to the policies of the Party and State; spending to support countries around the world to overcome the consequences of natural disasters and epidemics; and search and rescue work.

The subjects and levels of support are decided by the Minister of National Defense in the Regulations on organization and operation of the fund./.
