Strengthening public asset management during the transition period

Prioritize the arrangement of remaining surplus commune and ward People's Committee offices to convert their functions into educational, medical, and public service facilities. Do not allow loss, encroachment, or damage to assets and equipment during the current transition period.

PRIORITIES

To arrange headquarters for commune-level administrative units (AUs) after the rearrangement, Lam Dong Provincial People's Committee has issued specific instructions.

Before the reorganization, Lam Dong had a total of 137 commune-level administrative units (including 106 communes, 18 wards and 13 towns). After the reorganization, Lam Dong has 51 new commune-level administrative units, including 9 wards and 42 communes, a reduction of 86 commune-level administrative units, 9 wards and 77 communes, reaching a rate of 62.77%. Of the 51 commune-level administrative units formed after the reorganization, 18 administrative units merged into 2 communes; 26 administrative units merged into 3 communes, 4 administrative units merged into 4 communes; 1 administrative unit merged into 5 communes and 2 commune-level administrative units remained unchanged. 2 commune-level administrative units that remained unchanged without the reorganization were Ninh Gia commune of Duc Trong district and Ba Gia commune of Da Huoai district. Of which, Ba Gia commune changed its name to Da Huoai 3 commune based on the original status of natural area and population.

For the headquarters of the People's Committees of districts and cities, priority is given to arranging working headquarters for newly established administrative units of wards and communes in the area. For the headquarters of the People's Committees of the remaining communes, wards and towns in the province, based on the number of administrative units arranged in the new communes and wards, select the most suitable existing headquarters in terms of location, area, scale, etc. to be the headquarters of the People's Committee of the new administrative unit. In case there is a shortage according to the working quota compared to the payroll, the locality proposes to arrange additional headquarters of the arranged communes at its unit to make the most use of available facilities and headquarters.

With the remaining surplus headquarters, according to regulations, priority is given to converting the function to a career facility (education , health). After review, if there is really no need to use it, it will be transferred to the land fund management unit or the unit with the function of managing and trading houses of the province for management and exploitation.

For public service establishments, maintain or continue to use or comply with the real estate arrangement and handling plan approved by competent authorities.

The expected number of district and commune-level administrative unit headquarters after the rearrangement in the whole province is 1,442, of which 284 are working headquarters; 1,158 are public service establishments. After the rearrangement of administrative units, the number of establishments that continue to be used is 1,256, of which 251 are working headquarters; 1,005 are public service establishments. The number of surplus headquarters is 186, of which 33 are working headquarters (4 transferred, 1 recovered, 28 transferred to the Land Fund Development Center), and 153 are public service establishments (53 transferred, 3 recovered, 97 transferred to the Land Fund Development Center).

EFFECTIVE IN USE

Lam Dong Provincial People's Committee has recently issued a plan to review and develop a plan to handle assets after the reorganization of the administrative apparatus at all levels of Lam Dong province. The goal is to ensure that the handling of assets after the reorganization of the administrative apparatus is effective and transparent, without loss or waste of state assets; ensuring compliance with management practices in the coming time; and enhancing the effectiveness and efficiency of implementing policies and laws on practicing thrift and combating waste.

The Provincial People's Committee requests departments, branches, districts, cities, communes, wards, towns, and related units in the province to specifically define the work contents "clearly define people, clear work, clear time, clear responsibility, clear product, clear authority" in handling working headquarters, career facilities, assets, and means after rearranging the organization of administrative units at all levels that are not used, used ineffectively, or used for the wrong purpose.

At the request of the province, units and localities, based on their authority, proactively take measures and solutions to immediately and thoroughly handle problems and problems related to assets; at the same time, advise on the assignment, transfer or transfer of assets to put them into exploitation and effective use, and arrange for the effective use of working offices and public service facilities in the area, especially for working offices and public service facilities after the implementation of the arrangement of public service units.

For matters beyond their authority, units and localities need to promptly review and clearly report on issues related to policies and mechanisms, and legal regulations; propose solutions, the responsible agency to resolve, and the competent authority to decide to the superiors and competent agencies for timely consideration and direction. The province said it will strictly handle the responsibility of organizations and individuals who allow the situation of working offices and public service facilities to not be used or to be used ineffectively, causing waste of resources.

Lam Dong Provincial People's Committee also assigned the Provincial Department of Finance to continue reviewing and inspecting the quantity and management of houses and land used as headquarters and public service facilities of the province to implement the arrangement of administrative units; the plan to arrange the working headquarters of 51 new commune and ward administrative units.

For surplus house and land addresses and those transferred to local authorities for handling, the Department of Finance is responsible for guiding the People's Committees of communes and wards (new) to continue reviewing the needs of their locality (in the fields of health , education, community services) to prioritize the arrangement according to regulations. After there is no longer a need to use for the above purposes, a plan will be prepared and sent to the competent authority to transfer to the central units if there is a shortage compared to the needs or to the Land Fund Development Center, the Provincial Housing Development Center for management, exploitation and use according to regulations.

The Department of Finance is responsible for guiding units and localities on the procedures for handing over assets so that localities can arrange them for community service or assign them to exploiting units in accordance with the regulations and authority of the Law on Management and Use of Public Assets and guiding decrees. While waiting for the province to resolve, the Department of Finance guides units to continue managing, protecting or hiring services to protect, absolutely not allowing loss, encroachment, or damage to assets and equipment.

For the People's Committees of newly established communes and wards after the arrangement of commune-level administrative units, the Provincial People's Committee requires management, monitoring, and proper use, efficiency, and compliance with the Law on Management and Use of Public Assets for the arranged headquarters and public service facilities; review and assess the actual usage needs of the surplus headquarters and facilities approved by the Provincial People's Committee for handling according to the arrangement plan.

Lam Dong Provincial People's Committee also requested the provincial functional agencies to inspect and supervise the management and use of public assets, establish working groups to urge and provide direct guidance at agencies, organizations, units and localities with a large number of headquarters and facilities, complex nature, and slow processing progress; strictly handle the responsibilities of collectives and individuals who do not perform or do not fully perform assigned tasks, especially the responsibilities of the heads, affecting the progress and effectiveness of the work of arranging and assigning headquarters and facilities under their management.
