On the afternoon of July 30 in Hanoi , the Department of Radio, Television and Electronic Information (PTTH&TTĐT - Ministry of Culture, Sports and Tourism) held a conference on online advertising.
The conference was attended by representatives of advertising service businesses in Vietnam; Vietnamese brands and businesses with advertising activities, media companies, and MCNs producing digital content.

More regulations, more sanctions
At the Conference, Deputy Director of the Department of Radio, Television and Electronic Information Nguyen Thi Thanh Huyen disseminated many important contents about online advertising, clearly stipulated in the Law amending and supplementing a number of articles of the Law on Advertising.
According to Ms. Nguyen Thi Thanh Huyen, after being amended and supplemented with a number of articles, the Law has expanded regulations on online advertising to include electronic newspapers, electronic information pages, social networks, online applications, and digital platforms with internet connection to increase comprehensiveness and coverage.
The law is expected to open up opportunities for the advertising industry to enter a new stage of development, more professional, systematic and closer to international standards. At the same time, it still preserves its own identity, the core element that creates the value and competitiveness of Vietnamese advertising in the context of globalization.
Regarding the contents expected to be stipulated in the draft Decree detailing a number of articles and guiding the implementation of the Advertising Law, Ms. Nguyen Thi Thanh Huyen said that there will be specific regulations on the waiting time to turn off, features, and icons to turn off advertising; specific regulations on the responsibilities of online advertising service providers; transparency of advertising activities for advertising service providers when establishing and operating intermediary digital platforms to provide services.

In particular, the regulation will clearly state the process for blocking and removing illegal advertisements online. In particular, illegal advertisements on the internet will be blocked and removed within 24 hours at the latest. For advertisements that violate Vietnam's national security, they will be promptly blocked and removed within 24 hours of the request.
Assessing online advertising activities and state management of advertising activities in recent times, Director of the Department of Radio, Television and Electronic Information Le Quang Tu Do said that awareness and actions in complying with Vietnamese laws and ensuring brand safety of brands, advertising agencies, and cross-border advertising platforms have all been significantly improved.
“For example, if in 2023, the Department considers and handles 10 businesses, in 2024 there will be only 6 businesses and in the first 6 months of 2025 there will be only 2 businesses being considered and handled. However, there is still a situation where some small and medium-sized enterprises do not fully understand the regulations on advertising,” said Mr. Le Quang Tu Do.
Consider limiting the appearance of celebrities who violate the law
Mr. Le Quang Tu Do also pointed out that currently, there is still a situation where domestic brands and advertising agencies continue to allow advertisements to be installed in illegal content, without a radical solution to end the violation. Many large enterprises have been fined many times.
For violations by famous and influential people, one of the most common violations today is advertising that is inconsistent with one of the published documents as prescribed (self-published by the organization or enterprise or certified by the management agency).

Along with that, advertising foods that have therapeutic and curative effects; advertising incorrectly or causing confusion about the quality, price, and uses of registered or announced products, goods, and services (exaggerated advertising).
In addition, some famous and influential people also use their personal reviews and experiences to introduce and advertise products despite having signed a contract with the brand or representing the brand....
To enhance the effectiveness of state management, Mr. Le Quang Tu Do said that the Ministry of Culture, Sports and Tourism will actively implement the legal provisions of the Law amending and supplementing a number of articles of the Law on Advertising; develop and complete the Decree detailing and guiding the implementation of the Law on Advertising, the Decree on administrative sanctions for violations in the field of advertising or the law on providing and using online content services.
Strengthen supervision and inspection, or coordinate with competent agencies inside and outside the Ministry to inspect and strictly handle organizations and individuals violating laws related to the advertising field.
At the same time, consider and coordinate with the Department of Performing Arts to implement measures to restrict and control artistic activities, information, and images in the press and media of artists and celebrities who violate the law.
Editor Quang Minh and MC Van Hugo were each fined more than 100 million VND for advertising violations.
The Ministry of Culture, Sports and Tourism will also closely coordinate with the Ministry of Health, the Ministry of Industry and Trade, and specialized agencies to enhance the effectiveness of online advertising activities. In case of detecting complicated cases with signs of criminality, the Ministry will transfer the investigation agency to the Ministry of Public Security for consideration and handling according to regulations.
For cross-border advertising and social networking platforms, the Department of Broadcasting and Electronic Information requires strengthening filters, technical solutions, technology and personnel to proactively review and block content that violates Vietnamese law; scan for re-posted content, pages and channels that violate the law to thoroughly block and remove them; do not install ads on violating content; turn off ad display, stop sharing advertising money for violating videos , pages and channels; consider tightening conditions for enabling monetization, ensuring that only content that complies with the law can share advertising money.
The Department also calls for the cooperation of the entire online advertising ecosystem, thereby building a healthy, honest, creative and responsible digital advertising environment. Compliance with the law is not only an obligation, but also the foundation for sustainable development in the digital age.
At the Conference, representatives of advertising service businesses in Vietnam; brands, Vietnamese businesses with advertising activities, media companies, and MCNs producing digital content expressed their commitment to comply with Vietnam's laws on advertising in order to develop a healthy and modern advertising market.
At the same time, propose many solutions to create space for advertising activities to develop while still ensuring compliance with legal regulations.
