How are highway fees collected from state investment?

Which highways are tolled?

The Government has just issued Decree No. 130 regulating the collection of highway usage fees for vehicles traveling on highways owned by the entire people, represented by the State as the owner and directly managed and exploited.

Accordingly, expressways owned by the entire people and directly managed and operated by the State are allowed to collect tolls when they meet the conditions of being designed and invested in according to technical standards and regulations on expressways and other relevant technical standards and regulations.

These routes must be completed and put into operation in accordance with the provisions of the Road Law, provisions of the law on construction and other relevant legal provisions, and have a property exploitation plan approved by a competent authority in accordance with the provisions of the law on management and use of public assets.

Vehicles traveling on these routes are subject to highway usage fees at level 1.

As for expressways that have been decided on investment policies before the effective date of the Road Law, when put into operation but do not meet the provisions in Clause 1, Article 45, Clause 2, Article 47 of the Road Law, toll collection will be implemented after completing the construction and installation of toll station infrastructure and equipment for toll collection.

Vehicles traveling on these routes are subject to level 2 highway tolls.

5 groups of subjects subject to fees

According to the Decree, highway usage fees are determined based on the actual distance traveled by the vehicle (km) and the fee corresponding to each type of vehicle (VND/km).

Subjects subject to highway usage fees are divided into 5 groups.

Group 1 includes vehicles with less than 12 seats, trucks with a load capacity of less than 2 tons; and public passenger buses.

Group 2 includes the following types of vehicles: vehicles with 12 to 30 seats; trucks with a load capacity of 2 tons to less than 4 tons.

Specific fees.

Group 3 includes the following types of vehicles: vehicles with 31 seats or more; trucks with a load capacity from 4 tons to less than 10 tons.

Group 4 includes the following types of vehicles: trucks with a load capacity from 10 tons to less than 18 tons; container trucks under 40 feet.

Group 5 includes the following types of vehicles: trucks with a load capacity of 18 tons or more; container trucks of 40 feet or more.

This Decree comes into force from October 10, 2024.

In the draft decree on collecting fees for using state-invested highways, the Ministry of Transport proposed choosing the option that the highway asset management agency will directly organize the fee collection.
