Many new points in the Land Law (amended) just passed

On the morning of January 18, immediately after the closing session of the 5th Extraordinary Session of the 15th National Assembly ended, a press conference was held on the results of the session.

Speaking at the press conference, Secretary General of the National Assembly and Head of the National Assembly Office Bui Van Cuong said that in order to meet urgent practical requirements, based on the provisions of the Constitution and laws, the National Assembly Standing Committee decided to convene the 5th extraordinary session of the 15th National Assembly to consider and decide on important contents.

After 3.5 working days, the 5th extraordinary session of the 15th National Assembly completed the entire proposed program and held the closing session.

At the closing session, the National Assembly passed the Land Law (amended) with 432 delegates in favor (accounting for 87.63% of the total number of National Assembly delegates), demonstrating the high consensus of the National Assembly delegates.

According to the assessment of the Secretary General of the National Assembly Bui Van Cuong, the National Assembly's approval of the Land Law (amended) consisting of 16 chapters and 260 articles has completed one of the most important legislative tasks of the 15th National Assembly term in accordance with the 2013 Constitution, the Party's policies and guidelines, directly the Resolution of the 13th National Party Congress and Resolution No. 18 of the 5th Conference of the 13th Party Central Committee.

The passage of the Land Law (amended) at this session, together with the Housing Law (amended), the Real Estate Business Law (amended) at the 6th Session and taking effect simultaneously from January 1, 2025, has met the requirements of synchronously perfecting policies and laws on land management and use in accordance with the institutions of developing a socialist-oriented market economy , so that land resources are managed, exploited, and used economically, sustainably, and with the highest efficiency; meeting the requirements of promoting industrialization, modernization, fairness, and social stability; ensuring national defense and security; protecting the environment; creating momentum to turn our country into a developed country with high income.

Mr. Cuong said that regarding the revised Land Law project, with issues that are mature, clear, and agreed upon, there is no reason not to pass it. If the draft law is passed in May (the 7th session), it will slow down development, especially national governance related to this field.

Providing more information about the draft Land Law (amended) recently passed by the National Assembly, Standing Member of the National Assembly's Economic Committee Phan Duc Hieu said that Article 138 of the law stipulates the consideration of recognizing land use rights for households and individuals using land before July 1, 2014.

Standing Member of the National Assembly's Economic Committee Phan Duc Hieu provided more information about the Land Law project (amended) recently passed by the National Assembly.

Article 138 stipulates a number of basic principles, which are assigned to the Government for detailed regulations. Given the nature of the Land Law, it is not possible to provide further details in the law. Therefore, the Government must provide specific and detailed regulations for each case, each time, records, documents, etc.

Responding to the question of how many Decrees will be issued to guide the implementation of the Land Law (amended), Mr. Hieu said that when submitting the draft law, the Government also submitted a draft Decree to be issued along with it.

Preliminary statistics show that there are about 65 provisions assigned to the Government for detailed regulations, therefore the Government will issue decrees to guide the implementation of these 65 provisions.

The number of drafts that the drafting committee sends with the draft law may only be an estimate. In reality, when implementing the law, during the process of discussion and detailed guidance on law implementation, the number of decrees may increase or decrease.

Mr. Hieu hopes that the Government will soon have a plan to implement the law, including drafting and promulgating decrees guiding its implementation, ensuring that the law soon comes into effect.

Regarding the new points of the newly passed revised Land Law, Mr. Hieu said that if listed in detail, there would be hundreds of new points.

In the revised Land Law, he personally believes that there are 5 new groups of issues. The first is the regulations to better protect the rights and interests of land users; this group has many regulations, with much discussed content such as expanding land use rights for Vietnamese citizens; land policies for ethnic minorities.

The second group is the regulations on land access for people and businesses. In particular, Article 79 (land recovery for socio-economic development in the national and public interest) is designed to recover land for the construction of socio-economic infrastructure and for production and business activities. This has been newly designed, fully institutionalizing Article 54 of the Constitution on land recovery only in cases of real necessity.

The third group of issues is regulations to improve land use efficiency. Mr. Phan Duc Hieu gave examples of contents such as: multi-purpose land, limits on land use conversion, narrowing down the cases requiring permission, accepting agricultural land conversion...

The fourth group is regulations on land finance, which separates the issues of land valuation, land price list, land rent stabilization, and enterprises paying annual land rent.

The fifth group is regulations to improve the effectiveness of State management of land use. It requires cutting down on administrative procedures to create convenience for people .
