Proposal to amend regulations to avoid using tattoos to evade military service

Current regulations only exclude offensive tattoos with content that is not suitable for the military environment. The Ministry of National Defense warns of the situation of citizens intentionally getting tattoos to avoid military service.

The Ministry of National Defense recently received a petition from voters in Dong Nai province, reflecting that the regulations on tattoos and tattooed letters when reviewing the selection criteria and calling citizens to serve in the Army are not appropriate. Voters pointed out that currently, some citizens have taken advantage of this regulation to intentionally tattoo their bodies before the examination to avoid performing military service, causing public discontent. Voters recommended that the authorities should study and adjust accordingly.

Responding to this issue, the Ministry of National Defense stated that the Vietnam People's Army is a trustworthy political force of the Party, State and people; citizens enlisting to serve in the Army must ensure the prescribed standards, including standards of political quality and ethics.

The content related to tattoos and tattoo letters of citizens joining the army is specifically regulated in Joint Circular No. 50/2016 of the Ministry of National Defense and the Ministry of Public Security regulating political standards for selecting and calling citizens to serve in the Vietnam Army. During the process of developing the circular, the Ministry of National Defense closely coordinated with the Ministry of Public Security to study the specific content of the regulations.

Current regulations on tattoos and tattoo writing of citizens enlisted to serve in the Army only apply to tattoos and tattoo writing under the skin (which change skin pigmentation and cannot be erased) that express political and moral thoughts such as tattoos and tattoo writing that oppose the regime, divide the nation, are horrifying, bizarre, sexually stimulating, or violent.

Tattoos and tattoos that are offensive in visible locations, tattoos and tattoos that cover a large area of the body, and tattoos and tattoos that are not suitable for the cultural environment in the Army, the performance of duties, and the image of etiquette and conduct of revolutionary soldiers. Citizens with tattoos and tattoos that do not fall into the above cases or can be erased will still be considered for selection to serve in the Army.

The content of regulations on tattoos and tattoo letters of citizens enlisted to serve in the Army is built on the basis of thoroughly grasping the viewpoints of the Party and the Central Military Commission on internal political protection work, in accordance with the nature and tradition of the Army and the nature and characteristics of military activities; at the same time, it is a necessary requirement to build a revolutionary, disciplined, elite and modern People's Army.

Performing military service is the sacred duty of every citizen to the Fatherland; the fact that some citizens deliberately tattoo their bodies before the recruitment examination in order to avoid performing military service is a self-abandonment of their rights and obligations to the Fatherland, demonstrating the degradation of political ideology and moral qualities.

The above cases do not meet the standards to serve in the Army; at the same time, local Party committees, authorities and functional agencies need to seriously consider and handle them to ensure the strictness and fairness of the law.

In order to promptly prevent acts of taking advantage of and evading military service every year, the Ministry of National Defense has directed to draw lessons and provide detailed and specific instructions on tattoos and tattooed letters when selecting and calling citizens to join the army, contributing to limiting acts of citizens taking advantage of and evading military service.

To overcome existing problems and improve the quality of recruitment and conscription in the coming time, the Ministry of National Defense requested the National Assembly delegation of Dong Nai province and People's Councils at all levels in localities to continue to promote their supervisory role in implementing the Law on Military Service, detect and strictly handle violations, contributing to ensuring social justice, so that the law on military service is strictly enforced.

In response to voters' opinions, the Ministry of National Defense will direct relevant agencies to continue researching and fully evaluating related policies and impacts; coordinate with relevant ministries, branches and localities to research, propose amendments, supplements and perfect the law on military service to ensure scientific, strict and practical compliance.
