The Provincial People's Committee has just issued a document directing the transfer ofeducational public service units under the district-level People's Committee to the commune-level People's Committee.
Accordingly, educational public service units (including junior high schools, primary schools, and kindergartens) under the district-level People's Committee will be transferred to the new commune-level People's Committee for management, ensuring the principle that "schools located in a commune or ward will be under the management of the commune or ward People's Committee".

Educational service units (including junior high schools, primary schools, and kindergartens) are public service units directly under the People's Committees at the commune level according to the area under their management; subject to the direct and comprehensive direction and management of the People's Committees at the commune level; at the same time, subject to the direction, management, and professional and technical guidance of competent agencies according to the provisions of law.
Educational institutions (including junior high schools, primary schools, and kindergartens) have legal status, their own headquarters and seals, are allowed to open accounts at the State Treasury and banks, and operate in accordance with the provisions of law.
The content of the transfer is to transfer all civil servant positions assigned by competent authorities in 2025 and the number of civil servants and contract workers assigned by competent authorities currently in existence at the time of transfer of educational public service units (including junior high schools, primary schools, and kindergartens) to the People's Committees at the commune level to receive, manage, and use according to the provisions of law.
Hand over finances, assets, records, documents and other contents related to educational institutions (including junior high schools, primary schools, and kindergartens) to the People's Committees at the commune level for receipt, management and use in accordance with the provisions of law, decentralization of the Provincial People's Committee and instructions of competent authorities.
The District People's Committee is responsible for presiding over and coordinating with relevant agencies and units to transfer educational institutions (including junior high schools, primary schools, and kindergartens) to the Commune People's Committee in accordance with legal regulations. The transfer and receipt of units must be completed no later than July 1, 2025.
Preside over and coordinate with relevant agencies and units to hand over officials, land, finance, assets, working facilities and related records and documents of educational institutions (including junior high schools, primary schools and kindergartens) to the People's Committees at the commune level to receive, manage and use according to the provisions of law, decentralization of the Provincial People's Committee and instructions of competent authorities.
The People's Committee at the commune level organizes the reception and handover of officials, land, finance, assets, working facilities, and records and documents related to educational institutions (including junior high schools, primary schools, and kindergartens) in a timely manner and in accordance with regulations; prevents loss of records, documents, and assets; quickly stabilizes the organization, clearly defines the responsibilities of organizational departments and individuals to ensure uninterrupted operations of the units.
After receiving educational institutions (including junior high schools, primary schools, and kindergartens), according to the prescribed authority, the People's Committee at the commune level shall review and rename educational institutions under its management authority (if necessary) to ensure compliance with the 2-level local government model.
At the same time, regulate the functions, tasks and powers of educational institutions (including secondary schools, primary schools and kindergartens) in accordance with the provisions of law; arrange, assign and implement regimes and policies for the number of people working at educational institutions (including secondary schools, primary schools and kindergartens) in accordance with current regulations.
Direct educational institutions (including junior high schools, primary schools, and kindergartens) to develop job placement plans that comply with regulations; arrange the number of employees according to approved job placement plans; develop operating regulations according to regulations.
Direct the development and approval of autonomy plans for educational institutions (including junior high schools, primary schools, and preschools) to ensure regulations.
Based on the regulations and instructions of the Central Government on the organizational model of public service units and other related contents, the People's Committee at the commune level is responsible for developing a project to arrange and consolidate educational service units (including secondary schools, primary schools, and kindergartens) to ensure streamlining, improve operational efficiency, and meet task requirements in the new situation.
