This morning, at the 9th session of the National Assembly, Session 2, Minister of National Defense Phan Van Giang presented the draft Law amending and supplementing a number of articles of 11 laws in the field of national defense, including: Law on National Defense; Law on Officers of the Vietnam People's Army; Law on Professional Soldiers, Workers and Civil Defense Officials; Law on Military Service; Law on Vietnam Border Guard; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Management and Protection of National Defense Works and Military Zones; Law on Militia and Self-Defense Forces; Law on National Defense and Security Education.
According to General Phan Van Giang, the amendment of some provisions of the above laws is to implement the conclusion of the Politburo and the Secretariat on the policy of amending and supplementing the Constitution and the Law on Organization of Local Government.
The Army organization has been streamlined, efficient, and effective to ensure compliance with the two-level local government. The merger of some central ministries and agencies has changed the names and responsibilities in implementing military and defense laws.
The draft law consists of 12 articles, including 11 articles amending and supplementing 11 laws and 1 article on enforcement.

Regarding the Law on Officers of the Vietnam People's Army, according to the Minister of National Defense, the revised content focuses on the arrangement of the political system's apparatus regarding the organization of two-level local governments.
Accordingly, the draft law eliminates a number of positions of commander, political commissar of provincial border guard command, deputy commander, deputy political commissar of provincial border guard command, commander, political commissar of district military command, deputy commander, deputy political commissar of district military command.
The removal of some of the above positions is to ensure compliance with the Central Military Commission's Project to continue to reorganize local military organizations to be "lean, compact, and strong" to meet the requirements of tasks in the new situation.
The draft law also adds the responsibility of the Chairman of the Provincial People's Committee to decide to call for training of reserve officers and call reserve officers to active service, train and inspect mobilization readiness and combat readiness for cadres, civil servants and reserve non-commissioned officers residing in the locality.
Regarding the Law on Military Service, the Minister of National Defense said that the bill proposes to transfer the authority of the district level to the provincial level for the following tasks: establishing a military service health examination council; deciding on the list of citizens called for military service, performing the obligation to join the People's Public Security Forces, the list of temporary deferment and exemption from military service; recognizing citizens who have completed their military service in peacetime; and organizing the handover of troops to units.
In addition, transfer the authority of the district level to the commune level for a number of tasks such as health check of non-commissioned officers and reserve soldiers; issue orders to call each citizen to register for military service for the first time, pre-selection and medical examination for military service, call for enlistment and performance of duty to join the People's Public Security.
Transfer the authority of the district-level military command to the regional defense command to decide: Remove from the list of military service registration, release from the quota for non-commissioned officers and reserve soldiers and take primary responsibility for organizing the military handover ceremony, receiving and handing over non-commissioned officers and soldiers who have completed their active duty.
Examining this content, Chairman of the National Defense and Security Committee Le Tan Toi agreed on the necessity of promulgating a law to institutionalize the Party's direction on the arrangement of two-level local government organizations, ensuring conformity and consistency of the legal system when amending the 2013 Constitution and laws related to organizational apparatus.
Regarding the regional defense command, Mr. Toi said that there were opinions that this was a unit under the provincial military command, and the command and leadership structure was still unclear. Therefore, it was suggested that the position of commander of the regional defense command should not be specifically regulated; instead, it should be reviewed and supplemented after there were specific regulations on the organization and command of the regional defense command.
