Abolish a series of circulars on red book issuance and land management

DNVN - The Ministry of Natural Resources and Environment has just issued Circular 20/2024/TT-BTNMT on the abolition of a series of legal documents in the field of land. The Circular takes effect from January 1, 2025, notably abolishing many regulations related to the issuance of land use right certificates (red books).

The abolished circulars include Circular 14/2017/TT-BTNMT regulating economic and technical norms in surveying, cadastral mapping, land registration and issuance of land use right certificates. In addition, Circular 07/2015/TT-BTNMT is also on the list when it comes to land use planning, cadastral survey and issuance of certificates for agricultural and forestry companies.

The abolition of a series of circulars and decisions related to land management is considered an important step to simplify administrative procedures.

In addition, Circular 30/2013/TT-BTNMT regulating the integration of surveying, establishing or correcting cadastral maps with registration, granting land use right certificates and building cadastral records was also officially abolished. Next is Circular 09/2011/TT-BTNMT, a document regulating bidding for the provision of public services for the granting of land use right certificates, house ownership rights and other assets attached to land.

Some other documents such as Circular 09/2006/TT-BTNMT guiding the conversion of land lease contracts when converting state-owned enterprises into joint stock companies are also subject to repeal. At the same time, Circular 20/2022/TT-BTNMT, Circular 11/2021/TT-BTNMT and Circular 18/2019/TT-BTNMT, along with many other documents related to land resource monitoring, land use planning and mapping of current land use status are also no longer effective from the beginning of 2025.

Notably, Circular 20/2024/TT-BTNMT also partially abolishes the contents of documents such as Circular 24/2019/TT-BTNMT, Circular 11/2022/TT-BTNMT and Circular 19/2023/TT-BTNMT. This abolition aims to reduce overlap in regulations and facilitate land management.

Along with the move of the Ministry of Natural Resources and Environment, the Hanoi People's Committee has recently issued Decision 67/2024/QD-UBND, officially abolishing two important decisions related to land use rights auctions in the city. Specifically, Decision 19/2019/QD-UBND and Decision 07/2023/QD-UBND will expire from December 1, 2024.

According to Decision 19/2019/QD-UBND, the Hanoi People's Committee has the authority to approve the starting price for land use rights auctions to allocate land or lease land with land use fees collected. Decision 07/2023/QD-UBND clearly stipulates that prices from 30 billion VND or more will be approved by the city, while the remaining cases will be decentralized to the district-level People's Committees. The abolition of these decisions is expected to overcome existing shortcomings and help the land use rights auction process become more transparent and effective.

The abolition of a series of circulars and decisions related to land management is considered an important step to simplify administrative procedures, create a clear legal corridor and improve the efficiency of land management and use in the coming time.
