The resolution was just passed by the National Assembly with 407/423 National Assembly delegates present in favor, accounting for 85.15% of the total number of delegates.
According to the Resolution, the People's Procuracy will initiate a lawsuit when no one initiates a lawsuit according to the law, despite notice or recommendation. The lawsuit is aimed at protecting the civil rights of vulnerable groups, including children, the elderly, people with disabilities, women who are pregnant or raising children under 36 months old, ethnic minorities in disadvantaged areas, and people who have lost their civil capacity or have difficulty in cognition.
In addition, the Procuracy also protects public interests, including important areas such as public investment, land, resources, ecological environment, cultural heritage, food safety and consumer rights.
The Procuracy will file a lawsuit after examining, verifying, and determining that the violation has caused damage to the civil rights of vulnerable groups or public interests, and after notification/recommendation but no one files a lawsuit.
The Procuracy may also file a lawsuit if it discovers violations during the settlement of another case or incident that cannot be settled in the same case, and there is no one to file a lawsuit.
The jurisdiction of the first instance trial belongs to the Regional Court, based on the defendant's place of residence or work, the place where the violation occurred or the resulting damage occurred.
Regional and provincial-level procuracies and the Supreme People's Procuracy may directly initiate lawsuits or assign cases for complicated cases, cases of great value, cases with foreign elements or cases affecting security and foreign affairs.
