Seminar on the role of commercial arbitration in providing legal support to businesses

On the afternoon of August 28, in Bac Nha Trang ward, the Ministry of Justice held a seminar on "The role of commercial arbitration in providing legal support for small and medium-sized enterprises". Comrades: Nguyen Thanh Ngoc - Deputy Minister of Justice; Le Ve Quoc - Director of the Department of Dissemination, Education of Law and Legal Aid (Ministry of Justice) and Mr. Le Xuan Than - Director of the Vietnam International Arbitration Center Branch in Khanh Hoa, Chairman of the Provincial Lawyers Association chaired the seminar. Attending the seminar were many legal experts; representatives of departments, branches, agencies, organizations, lawyers, jurists and many representatives of small and medium-sized enterprises.

At the seminar, delegates discussed the role, significance and practical value of commercial arbitration in providing legal support for small and medium-sized enterprises; the current status of commercial arbitration in Vietnam. At the same time, they shared practical experiences, proposed solutions and recommendations to improve mechanisms and policies to support legal support for enterprises. Some delegates also raised the issue of the role of commercial arbitration in the context of implementing Resolution No. 68, dated May 4, 2025 of the Politburo on private economic development and issues of legal support for enterprises.

Delegates agreed that choosing commercial arbitration to resolve disputes in business operations is more effective than other forms. However, in recent times, the rate of domestic enterprises using commercial arbitration has been low, limited to FDI enterprises or contracts with international elements. Many delegates recommended that it is necessary to strengthen the dissemination of commercial arbitration; perfect the law on commercial arbitration, paying attention to the role of commercial arbitration in the context of implementing Resolution No. 68.
