Continuing the 49th session, on the morning of September 5, under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly Standing Committee gave opinions on the draft Law on Vietnam Civil Aviation (amended).

Presenting at the meeting, a representative of the Ministry of Construction said that the development of the draft Law on Civil Aviation of Vietnam (replacement) is necessary to institutionalize the Party and State's guidelines and policies, perfect the mechanisms and policies in the field of civil aviation; and implement Vietnam's commitments to the international community...

Implementing the spirit of innovation in law-making thinking, the draft Law on Civil Aviation (replacement) only regulates the framework issues of principles and contents under the authority of the National Assembly . Therefore, the draft of the new Law has been rearranged and restructured to include 11 chapters and 107 articles (95 articles less than the current law).

Accordingly, some provisions in the draft Basic Law inherit the current law. The draft Law has abolished some contents that are no longer suitable and amended the provisions allowing civil aviation activities of the armed forces and other state agencies, the operation of official aircraft of the armed forces or other state agencies serving official purposes...

The draft law also amends regulations on planning, investment in construction, and exploitation of airports and works at airports to be consistent with the practical activities of airport planning, consistent with the legal system on planning; creates favorable conditions for economic sectors to participate equally in investment in construction and exploitation of airports; synchronously deploys solutions and mechanisms on investment and construction so that port enterprises and enterprises owning works can exercise their investment rights and obligations according to advanced and popular models of countries around the world...

The draft law amends the provisions on the list of fees, charges and prices in the aviation sector in the Law on Fees and Charges and the Law on Prices to be consistent with the State's management objectives in accordance with the provisions of the law on fees, charges and prices; ensures revenue for investors and port enterprises in maintaining costs related to operations at airports; improves service quality; ensures that the aviation market operates in accordance with market mechanisms and is effectively controlled by the State.

Regarding the preliminary examination of the draft Law on Vietnamese Civil Aviation (amended), Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung stated that the Standing Committee of the Committee on Law and Justice agreed with the addition of provisions to institutionalize the Party's viewpoints and policies on strengthening socialization and mobilizing non-state resources to participate in investment in transport infrastructure. However, the Committee proposed to review and revise specific provisions to ensure they are consistent with the content that needs to be adjusted...

Concluding the session, Vice Chairman of the National Assembly Nguyen Khac Dinh said that after receiving comments from the National Assembly Standing Committee at the session, the draft Law is eligible to be submitted to the National Assembly for consideration at the 10th session. He suggested that the drafting agency advise the Government to continue reviewing and clarifying the scope of the draft law for some types of unmanned aircraft and other flying vehicles, ensuring that there is no duplication or overlap with the provisions of the Law on People's Air Defense, but also not leading to a legal gap in regulating related types of vehicles.

Vice Chairman of the National Assembly Nguyen Khac Dinh requested the drafting agency to coordinate with relevant agencies to study, carefully review, propose revisions and complete specific regulations on the interpretation of terms; issues of management and effective socio-economic exploitation of low-altitude space, including principles on aviation infrastructure planning, investment policies for the development of aircraft production, policies on the use of light aircraft to serve socio-economic sectors, rescue, national defense, security, etc.
