Contribute to perfecting the law on State compensation liability in the new situation

On the morning of July 25, in Khanh Hoa province, the Department of Registration of Secured Transactions and State Compensation (Ministry of Justice) coordinated with the Khanh Hoa Department of Justice to organize a seminar on "Orientations for perfecting the law on State compensation liability in the new context". Attending the seminar were representatives of a number of departments, branches, legal experts, and judicial officials of 3 provinces: Khanh Hoa, Lam Dong, and Dak Lak.

At the seminar, delegates discussed the implementation of the Law on State Compensation Liability in 2017 and documents guiding its implementation in civil litigation and enforcement activities in 3 provinces; difficulties in organizing the implementation of the law and some institutional shortcomings in the implementation process, such as: There are still delays and failure to fulfill the responsibility of settling compensation; coordination between agencies when performing the task of state management on state compensation is sometimes and in some places not proactive and regular; victims still face difficulties in exercising their right to request compensation; procedures for settling compensation are not feasible; some provisions of the law are not suitable for the organization of the apparatus according to the 2-level local government model and the policy of promoting decentralization and delegation of power; the team of civil servants performing the work of compensation for state liability at the local level still lacks experience...
