Removing staffing difficulties and unleashing brainpower

The draft decree on contracts for the performance of duties by civil servants has just been sent by the Ministry of Home Affairs to the Ministry of Justice for appraisal.

The biggest and most groundbreaking change of this draft decree compared to current regulations on recruitment and use of officials is that it has “broken” the staffing barrier to attract high-quality talent. This is the biggest change, allowing state agencies to sign labor contracts to attract managers, business administrators, outstanding and outstanding entrepreneurs, along with jurists, lawyers, experts, and leading scientists in the field.

These subjects are not on the payroll of the agency, organization, unit... Not only experts, the subjects signed contracts also include a number of leadership and management positions in types of work such as: drafting legal documents; programs, topics, projects on economics , science and technology, innovation; digital transformation, development of artificial intelligence technology... within a certain period of time. Signing contracts for these positions is not an "appointment", the person invited to sign the contract does not need to meet a number of standards and conditions of the corresponding leadership and management positions.

The budget for implementing the contract signing under this draft decree is guaranteed by the state budget, but the breakthrough point is that it is outside the salary fund, outside the administrative budget of the agency, organization, or unit. This helps to resolve the situation in many cases where the actual demand exceeds the allocated quota, or there is not enough regular spending to ensure the signing of the contract.

The draft decree also clearly states that this form of labor contract signing will not be used to replace the recruitment of civil servants. This is only a supplementary, flexible mechanism to solve urgent and unexpected tasks. Specifically, labor contracts will have a fixed term, not exceeding 24 months for labor contracts (leadership, management and professional positions) and not exceeding 36 months for service contracts.

It can be seen that, once completed and issued, this decree is an important step, concretizing the resolutions of the Politburo and the Government on attracting and promoting talented people; unleashing their brainpower, serving important national tasks without creating a fixed payroll burden and maintaining the initiative of state agencies.

These changes are a major breakthrough, demonstrating a change in thinking in the management and use of human resources in the public sector, towards optimizing operational efficiency and adaptability to increasingly complex and specialized work requirements in the new era.
