The Ministry of Justice announced the appraisal dossier of the draft Decree of the Government stipulating the regime, policies and guarantees for organizations and individuals working in searching for and collecting martyrs' remains, drafted by the Ministry of Justice .
Proposal to increase benefits and allowances
According to the Ministry of National Defense , the force directly participating in the activities of searching for and collecting martyrs' remains is a special labor force, doing very hard and toxic labor, having to work regularly and continuously from 10 hours/day to 12 hours/day, in conditions far from home, far from family, far from residential areas.
They work in harsh climates and weather, rugged and difficult terrain; high labor intensity, greatly affecting health; many officers and soldiers have sacrificed or been injured while performing their duties.
The Ministry of National Defense cited that from 1994 to present, 24 officers and soldiers on search and recovery missions from Vietnam and Laos have died (21 from Vietnam, 3 from Laos), 94 people were injured (89 from Vietnam, 5 from Laos) and 26 people (from Vietnam) suffered from serious illnesses.
On the other hand, along with the socio-economic development, from 2013 to now, the Government has adjusted the basic salary level 7 times; prices of goods have increased frequently, the country's socio-economic development has developed, but the levels of allowances, direct support for the task of searching for and collecting martyrs' remains; health care support levels, ensuring extra meals; learning Lao and Cambodian languages have not been adjusted appropriately.
Therefore, the Ministry of National Defense proposed to increase the level of health allowance; allowance level; additional meals to restore labor capacity; additional funding to study Lao and Cambodian languages when performing tasks abroad... at the same time, strictly and uniformly regulate the time to be counted; authority and responsibility for payment of regimes and policies to overcome difficulties and obstacles in the implementation process.
In the draft decree, the Ministry of National Defense proposed a number of new policies compared to current ones.
Specifically, the monthly responsibility allowance is increased by 0.5 times compared to the basic salary according to the Government's regulations at the time of implementing the regime for salary earners and compared to the military rank allowance for non-commissioned officers and soldiers. The period of enjoyment is from the actual month of performing the task of searching for and collecting martyrs' remains to the month of completing the task according to the plan of searching for and collecting martyrs' remains of the competent authority.
The additional allowance is equal to 20% of the current salary of the military rank or grade plus the leadership position allowance, seniority allowance exceeding the framework (if any) for those receiving salary or current military rank allowance for non-commissioned officers and soldiers when performing duties domestically; equal to 100% of the current salary of the military rank or grade plus the leadership position allowance, seniority allowance exceeding the framework (if any) for those receiving salary or current military rank allowance for non-commissioned officers and soldiers when performing duties overseas.
The above allowance, as stated by the Ministry of National Defense, is calculated monthly. In case of insufficient month, it is implemented as follows: 15 days or more is calculated as 1 month, less than 15 days is calculated as 1/2 month.
The Ministry of National Defense also proposed that military officers searching for martyrs' remains receive additional food equal to twice the basic food allowance of non-commissioned officers and infantry soldiers when on duty abroad. The additional food allowance is calculated from the date of departure abroad to carry out the task of searching for and collecting martyrs' remains to the date of re-entry; equal to one time the basic food allowance of non-commissioned officers and infantry soldiers when on duty domestically, calculated based on the actual days of searching for and collecting martyrs' remains (the additional food allowance is included in the meal, not paid in cash).
Military officers searching for martyrs' remains will receive a compensation of 0.2 basic salary/person/day calculated based on the actual days spent on surveying, verifying information, organizing search activities, and collecting martyrs' remains (including time spent mobilizing forces and examining and treating patients).
During the actual day of duty, if the duty is less than 4 hours, it is counted as half a day, from 4 hours or more, it is counted as 1 day. When enjoying the above allowance, there is no business trip allowance.
In addition, health allowance of 1,500,000 VND/person (no more than 2 times/year) is calculated as follows: Time spent on the task of searching and collecting martyrs' remains (including time spent searching and collecting martyrs' remains domestically and internationally; if interrupted, it will be accumulated) from 6 months to 12 months is paid twice; less than 6 months is paid once.
Team leaders, political commissars, deputy team leaders, and deputy political commissars of teams searching for and collecting martyrs' remains are supported with phone bills of VND 200,000/month.
Regime when on duty abroad
The Ministry of National Defense proposed that military officers searching for martyrs' remains abroad receive a regional allowance equal to one time the basic salary as prescribed by the Government at the time of implementing the regime for salary earners, compared to the allowance for the rank of private for non-commissioned officers and soldiers.
The allowance is calculated monthly. In case of less than a month, it is calculated as follows: 15 days or more is calculated as 1 month, less than 15 days is calculated as 1/2 month. The allowance period is from the month of departure abroad to perform the task of searching for and collecting martyrs' remains to the month of re-entry into the country.
The drafting agency also proposed to support Lao and Cambodian language learning for forces working in Laos and Cambodia at the rate of VND 2,000,000/person/year (for no more than 3 years).
In case of injury or illness requiring examination and treatment at medical facilities abroad, the medical examination and treatment costs will be paid. If the person has to be transferred back to the country for treatment, the actual transportation costs will be paid. The team searching for and collecting the remains of martyrs will pay the above costs and settle the accounts according to regulations.
The time spent on searching for and collecting martyrs' remains abroad is calculated by converting working time according to the coefficient of 1 year equal to 1 year and 6 months to receive a one-time allowance when leaving active service according to current regulations.
