Better control of advertising regulations is needed.

BTO-Continuing the 8th session of the 15th National Assembly, this afternoon, November 8, the National Assembly worked in groups to discuss the Draft Law amending and supplementing a number of Articles of the Law on Advertising. The National Assembly Delegation of Binh Thuan province participated in the discussion in group 15.

Commenting on this Law Project, National Assembly delegate of Binh Thuan province Dang Hong Sy said that compared to the 2012 Law, some contents have not been studied and amended in time. Specifically, in Article 5, on the responsibility of State management of advertising activities, according to the review report, the responsibilities of the Government, the Ministry of Culture, Sports and Tourism, the Ministry of Information and Communications, the Ministry of Health , the Ministry of Agriculture and Rural Development and relevant agencies in coordination with the Ministry of Culture, Sports and Tourism and the responsibilities of localities have been clarified.

However, delegate Dang Hong Sy emphasized that such a separation of management would cause complexity in management. For example, agricultural products such as salt and medicinal herbs may be related to both the agricultural and health sectors, etc. In addition, currently, most advertising fields are on social networks. Therefore, the delegate proposed that the Ministry of Information and Communications should be assigned as the focal agency to assist the Government in implementing State management of advertising and have the main responsibility as the most appropriate and take the lead in coordinating with relevant ministries in the management field to ensure coverage and consistency.

At the same time, regarding the proposal in Article 5, delegate Dang Hong Sy also requested that other contents in the draft Law currently assigned to the Ministry of Culture, Sports and Tourism be transferred to the Ministry of Information and Communications for unified and synchronous management.

Regarding prohibited acts in advertising in Article 8, delegate Dang Hong Sy said that the phrase “environmental hygiene” should be added in Clause 4 of this Article because in reality, many units use leaflets for propaganda and advertising but they are widely distributed, affecting urban aesthetics and affecting. At the same time, in Clause 14 of Article 8, delegate Sy also suggested that the phrase “illegal” should be amended and added to this regulation to become “Advertising that makes children think, speak, or act against morality, customs and traditions; against the law; adversely affecting the health, safety, or normal development of children” in order to prohibit advertisements that cause children to misunderstand or misunderstand the law.

In addition, through research, delegate Dang Hong Sy said that it is necessary to amend and supplement regulations on the time limit of billboards (Article 27). At the same time, it is proposed to supplement regulations that organizations and individuals when advertising on means of transport (such as buses, taxis, etc.) must report to local management authorities; it is necessary to plan outdoor advertising; solutions to sanction subjects of false advertising through phone numbers, social networks, etc.
