Continuing the 46th session, on the morning of June 9, the National Assembly Standing Committee gave opinions on receiving, explaining, and revising the draft Law on Teachers.
According to the report on major issues in explaining, accepting and revising the draft Law, there are opinions suggesting adding provisions prohibiting teachers from giving extra lessons in violation of the law and prohibiting extra lessons for students that teachers are directly teaching.
The Standing Committee of the National Assembly's Committee on Culture and Society stated that the draft Law does not prohibit extra teaching and learning, but only stipulates that teachers are not allowed to force students to participate in extra learning in any form in order to limit and overcome the widespread situation of extra teaching and learning.
" The Ministry of Education and Training has issued a document regulating extra teaching and learning, which stipulates that teachers are not allowed to give extra lessons to students they are directly teaching ," according to a report by the National Assembly's Committee on Culture and Society.

Explaining this issue, Minister of Education and Training Nguyen Kim Son said that the regulation "students must not be forced to participate in extra classes in any form" reflects the ethical viewpoint of teachers rather than being a professional regulation.
Regarding the reason for the regulation prohibiting teachers from tutoring students who are directly teaching in class, Mr. Nguyen Kim Son said that in their responsibility to perform their duties, teachers must complete the task of equipping their students with knowledge during regular class hours.
" If a teacher fails to complete the task during regular school hours, it means that he or she has not fulfilled his or her public duty. If he or she continues to teach the content that is part of his or her public duty and must be done at home, it will lead to distortions, causing the teacher to not fulfill his or her public duty, " said the Minister.
According to the Minister of Education and Training, teachers are allowed to teach their students right in school for good or bad students who are preparing for graduation exams. This is clearly regulated.
" This regulation is intended to strictly implement public service responsibilities; teachers must fulfill their responsibilities ," Minister Nguyen Kim Son emphasized.

Speaking at the meeting, Chairman of the Delegation Work Committee Nguyen Thanh Hai said that the Ministry of Education and Training has issued Circular 29 and has detailed instructions on extra teaching and learning, but extra teaching and learning still have variations.
According to Ms. Nguyen Thanh Hai, tutoring can be understood as an activity organized by teachers or professionals to teach outside of regular school hours, outside of the main curriculum at school, including forms such as teaching at home, at the center, or online teaching. Teaching at home can also be students coming to the teacher's house or vice versa, tutors coming to the students' houses.
" In reality, since the regulations on extra teaching and learning were issued, many variations have appeared. For example, many teachers organize online teaching via Zoom, Google Meet... for their own students and still collect money. This form is very difficult to manage ," the Chairman of the Delegation Work Committee stated.
The draft law prohibits forcing students to participate in extra classes in any form, but Ms. Nguyen Thanh Hai said that in reality, there is still pressure on parents to voluntarily write applications for their children to take extra classes.
" Although there are circulars and specific instructions, there are still variations, so this law must be regulated to prohibit profiteering from extra teaching and learning, " Ms. Nguyen Thanh Hai suggested.

Vice Chairman of the National Assembly Tran Quang Phuong said that using the phrase "no forced extra classes" is appropriate and this also respects the right to study of students and parents.
According to the Vice Chairman of the National Assembly, with the same lecture in class, capable students can absorb 70% of the knowledge, but there are also students who absorb 50%, or 30-40%, and not all students can memorize the lesson after class.
" The thing is, we have to differentiate between forcing and not forcing students to take extra classes because in reality there are many variations such as forcing students' families to apply, forcing them to study at my school instead of that school, " said Mr. Tran Quang Phuong.
Proposing to re-examine the issue of prohibiting teachers from tutoring their own students in class, the Vice Chairman of the National Assembly said that such a ban should not be imposed because in reality there are many cases where students find their teachers' teaching easy to understand and want to learn from their own teachers, but are banned from doing so because it is unreasonable.
