Ministry of Finance provides additional guidance on handling public assets when rearranging administrative units

On June 13, the Ministry of Finance issued Document No. 8380/BTC-QLCS to the People's Committees of provinces and centrally-run cities, providing additional guidance on the arrangement, organization, and handling of headquarters and public assets when implementing administrative unit arrangements.

The document aims to implement the Prime Minister's Official Dispatch No. 80/CD-TTg dated June 1, 2025 on accelerating the implementation of the plan to handle assets after restructuring the apparatus and administrative units at all levels; at the same time, implementing the request of the Central Internal Affairs Committee on assigning Party Committees of ministries and branches to direct competent agencies to urgently review and handle houses and land that are public assets, ensuring effective exploitation and avoiding waste. On that basis, the Ministry of Finance has organized inter-sectoral working groups to work directly with localities to grasp the actual implementation situation.

According to the assessment of the Ministry of Finance through working sessions, many localities have developed plans to arrange, allocate, and handle assets and started to organize implementation, while at the same time perfecting the organization of housing management and business and land fund development centers to receive and exploit surplus housing and land facilities.

However, many localities have not yet fully and comprehensively implemented the plan; detailed plans have not been developed; the progress of asset handling is still slow; and the coordination of assets between localities and central agencies in the area still has many limitations.

The main reasons are the lack of guidance documents from industry management ministries, lack of strong leadership and direction at the local level, and loose coordination between agencies and units.

To speed up the progress of handling public assets during the process of administrative unit arrangement, the Ministry of Finance provides guidance on some additional contents. Specifically, in case the plan for arranging, assigning and handling assets has been approved by the competent authority but during the implementation process there is a change in form or content to comply with new regulations or practical requirements, it is only necessary to report to the competent authority for decision on handling according to the law on management and use of public assets, without having to adjust the plan or carry out procedures for preparation, status inspection, synthesis and approval according to Decree No. 03/2025/ND-CP dated January 1, 2025.

Second, by June 30, 2025 at the latest, administrative agencies under district-level administrative units must complete the handover of headquarters, public assets, and related records and documents to competent agencies, organizations, and units to avoid disruption of management, loss of assets, and impact on the provision of public services.

The Ministry of Finance also stated that from July 1, 2025, the new provincial People's Committees after the merger will inherit all the powers and responsibilities of the provinces and cities before the merger.

For housing and land facilities assigned to organizations with the function of housing management and business or local land fund development organizations for management, the advisory agency is responsible for reporting to the provincial People's Committee to decide on the exploitation and handling plan according to regulations, avoiding vacancy and waste.

Third, the conversion of public property functions, including the conversion of office buildings and public facilities to infrastructure assets, shall be implemented in accordance with Article 13 of Decree No. 151/2017/ND-CP dated December 26, 2017 or any amendments, supplements or replacements. The adjustment of land use planning, construction planning and related planning when converting functions must also comply with relevant laws and instructions of the Ministry of Agriculture and Environment, the Ministry of Construction and specialized management ministries.

Fourth, localities need to promptly grasp and implement new legal documents on decentralization and assignment of state management authority in the field of public assets and regulations on standards and norms for the use of public assets issued by the Government and the Prime Minister.

In addition, in case the two parties have agreed to exchange or transfer headquarters and public facilities to serve the requirements of arranging administrative units according to the two-level government model, they can temporarily hand over and receive them for immediate use, and at the same time complete the transfer procedures within 30 days from the date of temporary handover. Localities are also responsible for receiving houses and land facilities recovered and transferred by ministries and central agencies for preservation, exploitation and timely handling according to regulations.

The Ministry of Finance also requires localities to promptly report difficulties and problems and propose specific solutions to the Ministry of Finance and relevant agencies for handling according to their authority or report to competent authorities for resolution.
