Faced with the urgent need for common construction materials to meet key projects, the implementation of the 2024 Law on Geology and Minerals in many provinces and cities is facing a number of difficulties, requiring specific mechanisms and policies to resolve them.
According to the Ministry of Agriculture and Environment , the development and promulgation of a Government resolution on specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals is consistent with the spirit of Resolution No. 206/2025/QH15 of the National Assembly on mechanisms for handling difficulties and obstacles due to legal provisions. This is an urgent and important issue at the local level, which needs to be resolved soon to speed up the procedures for implementing development investment projects, key projects that need to start construction, and contribute to promoting socio-economic development.
Da Nang City has proposed that the Ministry of Agriculture and Environment (the agency in charge of drafting the above-mentioned Government resolution) consider a number of solutions to address the shortage of sand, gravel, stone, and soil for common construction materials. For example: removing obstacles in river sand and gravel exploration; demarcating a number of mining areas that do not auction mineral exploitation rights to quickly grant exploitation licenses, immediately providing common construction materials for public investment projects...
Faced with the situation of some mineral mines winning auctions for mining rights with unusually high sums of money recently, the city also proposed that the Ministry of Agriculture and Environment allow regulations to limit the number of auction rounds in the auction regulations; regulations on deposits...
Head of the Minerals Department (Department of Agriculture and Environment) Nguyen Hong Song said that the city proposed to improve regulations on auctioning mineral exploitation rights by adding regulations on deposit, capacity requirements of auction participants, sanctions for cases of "deposit abandonment" after winning the auction...
At the same time, develop a plan to auction mineral exploitation rights for mineral mines under the licensing authority of the locality in accordance with actual usage needs and organize the auction in accordance with the provisions of law with a reasonable deposit amount, at the highest level as prescribed. Thereby, in order to select a unit that is truly capable, experienced and uses advanced, modern technology to participate in mineral exploitation activities and perform well in environmental protection, overcoming the situation of "abandoning the deposit" after winning the auction.

The Department of Agriculture and Environment said that on August 22, 2025, the City People's Committee continued to issue Report No. 84/BC-UBND to the Ministry of Agriculture and Environment, proposing a number of solutions to remove difficulties and obstacles when implementing legal regulations in the field of geology and minerals. In addition, it recommended reducing a number of documents and procedures related to licensing the exploitation of minerals for common construction materials related to public investment projects...
Most of Da Nang's recommendations have been accepted and incorporated into the Government's draft resolution on specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals.
Then, on September 4, the City People's Committee continued to propose to the Government, the Ministry of Agriculture and Environment... to add subjects to be considered for granting certificates of registration for mineral recovery in the cases specified in Point b and Point d, Clause 1, Article 75 of the Law on Geology and Minerals 2024, including: construction contractors or organizations and individuals that meet the conditions prescribed by law on geology and minerals.
Da Nang makes this recommendation because in reality, in the city, many investors, developers or land users do not have the need to recover excess minerals (mostly Group IV minerals) during the implementation of construction investment projects. Meanwhile, the subjects proposed by the city to be added to the draft resolution of the Government have the need to recover excess minerals to provide common construction materials for projects.
The City People's Committee proposed to supplement regulations on areas with minerals that have been explored and identified as sources of raw materials to supply and supplement factories that are currently processing or using minerals, which have been identified and updated in the planning for mineral exploration, exploitation, processing and use (mineral planning group 1, mineral planning group II, provincial planning for mineral group III).
This proposal aims to remove difficulties in raw material sources for tunnel brick factories in the city to serve production activities.
