The National Assembly voted to pass the Law amending and supplementing a number of articles of the Law on Economical and Efficient Use of Energy.
Previously, the National Assembly heard a report on the explanation, acceptance and revision of the draft Law amending and supplementing a number of articles of the Law on Economical and Efficient Use of Energy. Accordingly, regarding the issue of key energy-using establishments, the Standing Committee of the Science , Technology and Environment Committee (KH,CN&MT) found that the draft Law submitted to the National Assembly stipulated that the list of key energy-using establishments to be developed and issued by the provincial People's Committee once a year is consistent with the policy of promoting decentralization, delegation of authority and the application of science, technology and digital transformation in management activities. Therefore, it is proposed to keep this content as in the draft Law.
Regarding the proposal to add a requirement for ad hoc review of establishments that generate unusually large energy consumption, the draft Law has provisions in Clause 14, Article 1, amending and supplementing Article 33 of the current Law on Economical and Efficient Use of Energy. Regarding the proposal to add provisions on the content of the Ministry of Industry and Trade building and operating the national database on energy saving, Clause 3, Article 45 of the current Law on Economical and Efficient Use of Energy stipulates the responsibility of the Ministry of Industry and Trade to "Organize the national energy database system". In which, the national database on energy saving is a component of the national energy database. Therefore, this content is not added to the draft Law.
Regarding the expansion of the scope of energy labeling for construction materials according to the Standing Committee of Science, Technology and Environment, construction materials used for buildings and works have a great impact on the energy efficiency of works. The addition of regulations on energy labeling for construction materials in the draft Law is the legal basis for the Ministry of Construction to organize the implementation of measures to use energy economically and efficiently in the construction industry, contributing to improving the competitiveness of enterprises and expanding the market towards green transition. Therefore, the addition of regulations on energy labeling for construction materials is necessary. Incorporating the opinions of National Assembly deputies, the draft Law has been reviewed and adjusted with related regulations to ensure consistency and synchronization; at the same time, the Ministry of Construction is assigned to specify this content.
Regarding the proposal to assess the feasibility of energy labeling, the Standing Committee of the Science, Technology and Environment Committee said that in order to prepare for the implementation of energy labeling for construction materials, the Ministry of Construction has been researching and developing a project, including the assessment of impact and feasibility such as choosing national or international standards suitable to the socio-economic conditions of our country, the capacity of testing organizations, the capacity of domestic manufacturing enterprises in each period and focusing on a number of subjects and types of construction materials.
The activity of energy labeling of construction materials is a new activity, so the draft Law has developed policies to encourage and support enterprises, organizations and individuals to comply with the provisions of Clause 17, Article 1 of the draft Law (Article 41 of the draft Unified Law). At the same time, the Ministry of Construction is assigned to promulgate a list and roadmap for applying energy labeling for construction materials (Clause 16, Article 1 of the draft Law, Clause 4, Article 39 of the draft Unified Law) in accordance with actual conditions.
Regarding the Fund for promoting the use of energy economically and efficiently, according to the Standing Committee of the Committee for Science, Technology and Environment, the regulation on the establishment of the Fund for promoting the use of energy economically and efficiently in the draft Law is necessary to institutionalize Resolution No. 55-NQ/TW dated February 11, 2020 of the Politburo. Currently, many countries in the world have also established energy saving funds to support activities of using energy efficiently (such as the United States, Denmark, Germany, Japan, Korea, China and the European Union).
The Fund's activities will promote investment and use of energy-saving technologies and equipment, contributing to increasing labor productivity, innovating the growth model, saving energy, ensuring energy security and protecting the environment. The draft Law has stipulated a number of main and principled contents on the Fund's organizational model, financial sources for establishing the Fund, and the Fund's operations under the trust method.
