On the afternoon of August 12, under the direction of Vice Chairman of the National Assembly Tran Quang Phuong, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Law amending and supplementing a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils.

Presenting the Report on some major issues on receiving and revising the draft Law amending and supplementing a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils, Chairman of the Committee for People's Aspirations and Supervision Duong Thanh Binh said: The draft Law has been comprehensively revised, with a structure of 5 chapters with 44 articles, 47 articles less than the current Law (of which 55 articles have been removed, 36 articles of the current Law have been inherited and amended, and 8 new articles have been added).

Based on the content, policies and number of newly removed, amended and supplemented articles, the Standing Committee of the People's Aspirations and Supervision Committee proposes that the Standing Committee of the National Assembly consider and decide to adjust the scope of comprehensive amendments and change the name to the Law on Supervision Activities of the National Assembly and People's Councils (amended).

Regarding the supervisory activities of the National Assembly and People's Councils, on the basis of more clearly defining the authority and responsibility of each supervisory entity; at the same time implementing the policy of strengthening the division of labor and decentralization in supervisory activities, the draft Law has amended and supplemented a number of supervisory activities of the National Assembly and People's Councils.

Accordingly, the regulations on thematic supervision of the National Assembly and the People's Council are amended in the direction that the National Assembly and the People's Council do not directly organize thematic supervision delegations. Every year, the National Assembly decides to select the topic of supervision and assigns the National Assembly Standing Committee or the Nationalities Council , the National Assembly Committee to assist the National Assembly in organizing the implementation, reporting the results of supervision for the National Assembly to consider, discuss at the session and issue a resolution on thematic supervision.

The People's Council decides to select the topic of supervision and assigns the Standing Committee of the People's Council and the Committee of the People's Council to assist the People's Council in organizing supervision and reporting the results for the People's Council to consider, discuss at the session and issue a resolution on thematic supervision. In addition, the Standing Committee of the National Assembly and the Standing Committee of the People's Council shall supplement the review of thematic supervision reports.

In addition to the National Assembly Standing Committee and the People's Council Standing Committee directly organizing thematic supervision delegations, based on the annual supervision program, the National Assembly Standing Committee may assign the Ethnic Council, the National Assembly Committee, and the People's Council Standing Committee to assign the People's Council's Board to assist the National Assembly Standing Committee and the People's Council Standing Committee in organizing thematic supervision, reporting the results for the National Assembly Standing Committee and the People's Council Standing Committee to consider and issue resolutions and conclusions on supervision...

The majority of opinions of the National Assembly Standing Committee agreed with the acceptance and revision of the draft Law; highly appreciated the transition from amending and supplementing a number of articles to comprehensive amendment.

National Assembly Chairman Tran Thanh Man said that this is an important step to institutionalize the Party's policy, especially Resolution No. 27-NQ/TW on continuing to build and perfect the socialist rule-of-law state of Vietnam in the new period.

According to the National Assembly Chairman, it is necessary to emphasize that the goal of supervision is to contribute to perfecting legal policies, ensuring discipline and order, and improving the efficiency of the state apparatus. The National Assembly Chairman noted that the authority between the supervision of the National Assembly and the People's Council must be clearly defined; the supervision of the provincial People's Council and the communal People's Council must be clearly defined; the division of tasks and powers between the National Assembly, the National Assembly Standing Committee, the Ethnic Council, and the National Assembly Committees; between the People's Council, the Standing Committee of the People's Council, and the People's Council's committees must be clearly defined to ensure that the principle of supervision is to point out strengths for promotion and limitations for timely overcoming; supervision must be conducted in a spirit of not causing difficulties for ministries, branches, and localities.

"The Law only stipulates major policies, principles, stability, and the authority of the National Assembly; it omits specific regulations, procedures for conducting supervisory activities; mechanisms for assigning implementation and some other contents," the National Assembly Chairman emphasized.

The National Assembly Chairman agreed that the regulation on supervision activities of agencies, organizations and individuals must comply with the order and procedures, and receive opinions from subjects directly affected by relevant agencies, organizations and individuals to contribute to draft laws, ordinances and resolutions according to the provisions of the law on promulgation of legal documents and related laws, which is a new supervision activity of the National Assembly Standing Committee, the Council of Nationalities and the Committees.

The draft Law needs to be built in the spirit of being extremely concise, easy to understand, easy to remember, easy to do, avoiding unnecessary redundancy and overlap. In his concluding remarks, Vice Chairman of the National Assembly Tran Quang Phuong suggested that, regarding the scope of regulation and scope of amendment, it is necessary to carefully review to ensure the full institutionalization of the viewpoint of innovation in supervision activities associated with innovation in law-making, strengthening decentralization, and studying and supplementing necessary regulations to improve the effectiveness and efficiency of supervision activities.

Carefully review the concept of supervision of the National Assembly and People's Councils to ensure clarity of content, consistency in nature and objectives of supervision activities, and harmoniously resolve the relationship between objectives and principles... The Vice Chairman of the National Assembly suggested that, based on the opinions of the National Assembly Standing Committee, the Committee for People's Aspirations and Supervision complete the report on acceptance, explanation and orientation to present to the Session of full-time delegates for discussion.
