The Ministry of Construction pointed out that the Hanoi - Bac Giang BOT Investment Joint Stock Company was established from a consortium of investors. The purpose of the consortium is to implement the project to renovate and upgrade National Highway 1, Hanoi - Bac Giang section, according to the signed BOT contract.

Meanwhile, Decree No. 108/2009 of the Government on investment under BOT, BTO, BT contracts and the Law on Investment under the Public-Private Partnership (PPP) method in 2020 both stipulate: PPP project enterprises are established with the sole purpose of signing and implementing specific project contracts and do not have the function of proposing new projects.

Thus, the proposal to expand the Hanoi - Bac Giang expressway to 8 lanes under the PPP method of Hanoi - Bac Giang BOT Investment Joint Stock Company is not in accordance with current legal regulations on the functions and scope of operations of enterprises.

In early May, the Hanoi - Bac Giang BOT Investment Joint Stock Company sent a document to the Ministry of Construction and the Vietnam Road Administration, proposing to expand the Hanoi - Bac Giang expressway to meet increasing transportation demand, improve service quality, and reduce traffic congestion and accidents.

The company said that the current traffic volume through the toll station is about 53,500 vehicles per day and night. Meanwhile, according to the financial plan, the maximum capacity is 46,000 vehicles per day and night. Due to the traffic volume increasing by about 11% per year, the road is overloaded, leading to frequent traffic jams, potential risks of accidents and increased transportation costs, affecting the competitiveness of the area.

Hanoi - Bac Giang BOT Investment Joint Stock Company has proposed to establish an investment policy to expand the expressway to 8 lanes. After being approved by competent authorities, the enterprise will implement the investment to ensure investment efficiency.

The project to renovate and upgrade National Highway 1, Hanoi - Bac Giang section under BOT form, is over 46 km long, designed to expressway standards, with a scale of 4 lanes, a roadbed width of 33-34 m, and an operating speed of 100 km/h. The project has a total investment of over 4,100 billion VND, put into operation since April 2016 and collects tolls for 21 years.

According to the Road Network Planning for the period 2021 - 2030, with a vision to 2050, the Hanoi - Bac Giang - Lang Son expressway is 153 km long, with 6 - 8 lanes. The entire route has three sections: Phu Dong, Hanoi - Bac Giang section is 46 km long, planned to be expanded to 8 lanes; Bac Giang - Chi Lang, Lang Son section is 64 km long, planned to have 6 lanes; Huu Nghi - Chi Lang, Lang Son section is 43 km long, under construction with 4 lanes, expected to open at the end of this year.
