Plan to implement the arrangement of district and commune-level administrative units in Ninh Binh province for the period 2023-2025

Pursuant to Resolution No. 37-NQ/TW dated December 24, 2018 of the Politburo on the arrangement of district and commune-level administrative units; Conclusion No. 48-KL/TW dated January 30, 2023 of the Politburo on continuing to implement the arrangement of district and commune-level administrative units in the 2023 - 2030 period; Resolution No. 595/NQ-UBTVQH dated September 12, 2022 of the National Assembly Standing Committee on continuing to implement the policy of arranging key units at district and commune levels in the 2023 - 2030 period; Resolution No. 35/2023/UBTVQH15 dated July 12, 2023 of the National Assembly Standing Committee on the arrangement of district and commune-level administrative units in the 2023 - 2030 period; Resolution No. 117/NQ-CP dated July 30, 2023 of the Government promulgating the Plan for implementing the arrangement of district- and commune-level administrative units for the period 2023 - 2025; Official Dispatch No. 557/CD-TTg dated June 18, 2023 of the Prime Minister on reviewing and finalizing regulations on implementing the arrangement of district- and commune-level administrative units for the period 2023 - 2030 and Official Dispatch No. 616/CD-TTg dated July 4, 2023 of the Prime Minister on reviewing and finalizing plans to implement the arrangement of district- and commune-level administrative units for the period 2023 - 2030; Notice No. 350/TB-VPCP dated August 24, 2023 of the Government Office announcing the Prime Minister's Conclusion at the National Online Conference on implementing the arrangement of district and commune-level administrative units for the period 2023 - 2030; Resolution No. 16-NQ/TU dated August 23, 2023 of the Provincial Party Executive Committee on the arrangement of district and commune-level administrative units of Ninh Binh province, for the period 2023 - 2030; Plan No. 138-KH/TU dated August 23, 2023 of the Provincial Party Standing Committee on the implementation of the arrangement of administrative units at district and commune levels in Ninh Binh province, period 2023 - 2030, the Provincial People's Committee issued the Plan to implement the arrangement of administrative units (abbreviated as administrative units) at district and commune levels in Ninh Binh province, period 2023 - 2025, specifically as follows:

I. PURPOSE, REQUIREMENTS

1. Purpose

a) Organize the dissemination and serious and effective implementation of the Resolution and Conclusion of the Politburo ; Resolution of the National Assembly Standing Committee and the Government; Telegrams and Conclusions of the Prime Minister; Resolution of the Provincial Party Committee; Plan of the Provincial Party Committee Standing Committee on the arrangement of administrative units at district and commune levels, creating changes in the awareness and actions of cadres, civil servants, public employees and workers in agencies, units and local authorities at all levels; creating consensus and support from the people and public opinion, especially related subjects, affected and influenced in the implementation of the arrangement of administrative units at district and commune levels.

b) Clearly define the time, roadmap, tasks to be performed, complete the goals, requirements, and tasks set forth by the Central and Provincial Party Committees in accordance with regulations, ensuring the time; assign specific tasks, responsibilities, and coordination between Departments, branches, People's Committees of districts, cities, and relevant agencies and units in the process of implementing and organizing the arrangement of administrative units at district and commune levels.

2. Requirements

a) The organization, implementation and arrangement of administrative units at district and commune levels are under the direct, concentrated and unified leadership and direction of the Party Committee; information and propaganda work is well implemented, raising awareness, creating high unity in the political system and consensus and support of the people. Determine the content of work associated with functions, tasks, responsibilities and promote the proactive and active role of agencies, units and localities; strengthen the leadership, direction and responsibility of the head in the process of organization and implementation.

b) The arrangement of administrative units must be consistent with the provincial planning, rural planning, urban planning and other relevant planning; at the same time, it must ensure the comprehensiveness, synchronization, methodicalness, scientificity, and suitability with the characteristics of each unit and locality. Carry out the arrangement of administrative units that do not meet the prescribed standards with related and adjacent administrative units to ensure the prescribed standards, create a strong driving force to promote socio -economic development for each administrative unit, promote the unique values ​​of the province and each locality; stabilize politics, maintain national defense - security, order and social safety; improve the material and spiritual life of the people; do not cause major disruptions, do not greatly affect production and business activities.

c) Arrange administrative units associated with innovation, streamlining the organization, operating effectively and efficiently, streamlining the payroll, restructuring and improving the quality of cadres, civil servants and public employees. Research and propose support policies, plans and roadmaps for arrangement, streamlining to ensure the number of cadres, civil servants, public employees, workers and part-time workers at the commune level, in villages and residential groups.

d) The order, procedures, contents of the plan, documents, and projects must comply with legal regulations and meet time requirements; specifically determine the roadmap, time, and tasks for agencies, units, and localities during the implementation process; regularly inspect, monitor, periodically summarize, and report on implementation results in accordance with regulations.

d) District and commune-level administrative units after the rearrangement must ensure the standards prescribed in Article 4 of Resolution No. 35/2023/NQ-UBTVQH dated July 12, 2023 of the National Assembly Standing Committee.

e) Timely arrange headquarters and public assets after arranging public service units in accordance with regulations, appropriately, and avoid waste.

II. TASKS, ROADMAP, IMPLEMENTATION TIME

1. Develop and issue implementation documents and organize implementation.

1.1. The People's Committees of districts and cities report to the Standing Committees of the District and City Party Committees to issue documents directing the implementation of the arrangement of commune-level administrative units in the period of 2023 - 2025 of the locality. Implementation time: To be completed before August 31, 2023.

1.2. The People's Committees of districts and cities report to the Standing Committee of the District Party Committee and the City Party Committee to decide on the establishment of the Steering Committee for the implementation of the arrangement of commune-level administrative units in the period 2023 - 2030 of the district and city.

Implementation time: Completed before August 31, 2023.

2. Organize implementation conference

2.1. Advise the Provincial Party Standing Committee to organize a conference to disseminate and implement the work content on the arrangement of administrative units at district and commune levels in the province, period 2023 - 2025.

Implementation time: Completed before August 29, 2023.

2.2. Districts and cities organize conferences to disseminate and deploy the work of arranging communal-level administrative units in the area.

Implementation time: Completed before September 7, 2023.

3. Dissemination, dissemination and propaganda work

Implement well the work of dissemination, popularization and propaganda to create unity in awareness and action throughout the political system from the province to the grassroots level; consensus and support of cadres, party members, civil servants, public employees, workers and people, especially related subjects, affected and influenced when implementing the arrangement of administrative units at district and commune levels in the province. All levels, sectors and localities focus on promoting information and propaganda work in the political system on the content of the arrangement of administrative units at district and commune levels in the province, period 2023 - 2025:

- Propose that Party committees at all levels organize the dissemination of this Plan to Party cells; propose that the Fatherland Front Committee and socio-political organizations carry out propaganda work throughout the entire organizational system from the provincial to the grassroots level.

- Local authorities at district and commune levels promptly and fully post information related to the arrangement of administrative units at district and commune levels on the district and commune electronic information portals/pages; post information on the arrangement of administrative units at district and commune levels at the headquarters of the Party Committee, People's Council, People's Committee at commune level, at cultural houses and community activity points in villages (hamlets), residential groups; direct the broadcasting systems of districts, cities, communes, wards, towns, villages (hamlets), residential groups to regularly propagate and report on the arrangement of administrative units so that people know and support the arrangement of administrative units at district and commune levels.

- Ninh Binh Newspaper, Provincial Radio and Television Station open special pages and columns, increase broadcasting time on the implementation of the arrangement of administrative units at district and commune levels in the period of 2023 - 2025 in the province.

Implementation time: Agencies, units and localities will start to propagate from the time this Plan is issued until the completion of the arrangement of administrative units at district and commune levels, period 2023 - 2025.

4. Develop and submit for approval the Master Plan for the arrangement of administrative units.

4.1. Data sources on natural area and population size of administrative units at district and commune levels to carry out the arrangement:

- The Department of Natural Resources and Environment provides data on the natural area of ​​district- and commune-level administrative units according to the provisions of Article 5 of Resolution No. 35/2023/UBTVQH15 dated July 12, 2023 of the Standing Committee of the National Assembly, as a basis for developing plans and projects to arrange district- and commune-level administrative units for the period 2023 - 2025 of the province.

Implementation time: Completed before September 5, 2023.

- The Provincial Public Security Department provides data on the population size of district- and commune-level administrative units according to the provisions of Article 5 of Resolution No. 35/2023/UBTVQH15 dated July 12, 2023 of the National Assembly Standing Committee, as a basis for developing plans and projects to arrange district- and commune-level administrative units for the 2023-2025 period of the province.

Implementation time: Completed before September 5, 2023.

4.2. Based on data on natural area, population size, and specific factors of each administrative unit provided and confirmed by competent authorities; conduct a review and identify district- and commune-level administrative units that do not meet the prescribed standards and must be rearranged, and adjacent related administrative units and administrative units encouraged to be rearranged to develop a Plan to ensure regulations, specifically as follows:

- The People's Committees of districts and cities review and develop a Plan for arranging administrative units at the commune level for the period 2023 - 2025 of the locality, report to the Standing Committee of the District Party Committee and City Party Committee; complete the Plan and send it to the Department of Home Affairs for synthesis to develop the overall Plan of the province.

Implementation time: Completed before September 25, 2023.

- The Department of Home Affairs shall preside over and coordinate with relevant agencies and localities to review and develop a master plan for the arrangement of district-level administrative units (including the merger of Ninh Binh city and Hoa Lu district, and the arrangement of affiliated commune-level administrative units; the adjustment and expansion of the administrative boundaries of Tam Diep city associated with the arrangement of affiliated commune-level administrative units); appraise, synthesize and develop a master plan for the arrangement of commune-level administrative units in Ninh Binh province, period 2023 - 2025.

Implementation time: Completed before October 20, 2023.

- The Provincial People's Committee reports to the Party Committee of the Provincial People's Committee to submit to the Standing Committee of the Provincial Party Committee the Overall Plan for arranging administrative units at district and commune levels in Ninh Binh province, period 2023 - 2025.

Implementation time: Completed before October 25, 2023.

- The Department of Home Affairs shall preside over and coordinate with relevant agencies and localities to advise the Provincial People's Committee to complete the Master Plan for arranging administrative units at district and commune levels for the period 2023 - 2025, report to the Ministry of Home Affairs for appraisal and submit to competent authorities for approval according to regulations.

Implementation time: Completed before October 31, 2023.

5. Develop a detailed project on the arrangement of administrative units at district and commune levels.

Based on the Master Plan for arranging administrative units at district and commune levels in Ninh Binh province approved by competent authorities, proceed to develop a detailed Project for arranging administrative units at district and commune levels for the period 2023 - 2025, as follows:

5.1. The People's Committees of districts and cities develop a project to arrange commune-level administrative units for the period 2023 - 2025 of the locality and report to the Standing Committee of the District Party Committee and City Party Committee.

Implementation time: Completed before February 15, 2024.

5.2. The Department of Home Affairs shall preside over and coordinate with relevant agencies, units and localities to develop a detailed project on the arrangement of district-level administrative units (including the merger of Ninh Binh city and Hoa Lu district, and the arrangement of affiliated commune-level administrative units; the adjustment and expansion of the administrative boundaries of Tam Diep city associated with the arrangement of affiliated commune-level administrative units); appraise, synthesize and develop a detailed project on the arrangement of commune-level administrative units in Ninh Binh province, period 2023 - 2025.

Implementation time: Completed before April 15, 2024.

5.3. Review, submit to competent authority for approval or approve according to authority the Provincial Planning; urban planning, rural planning and other related planning:

- The Department of Planning and Investment implements the supplementation of the content of the arrangement of administrative units at district and commune levels in the planning of Ninh Binh province for the period 2021 - 2030, with a vision to 2050, according to the direction of the Central Government and the province.

Implementation time: Completed to ensure progress and time as required.

- The Department of Construction guides the review and adjustment of urban administrative units related to the plan to arrange additional urban administrative units at the district and commune levels and measures to ensure and continue to improve urban quality after completing the arrangement; guides the adjustment and addition of urban and rural planning to ensure conformity with the plan to arrange administrative units at the district and commune levels; guides the implementation of urban classification (for cities and towns), advises on the review and inspection of reporting documents before submitting to the Provincial People's Committee.

Implementation time: Completed at the same time as the time to develop the Master Plan and Detailed Project for arranging administrative units at district and commune levels in Ninh Binh province, period 2023 - 2025.

6 6. Organize to collect voters' opinions on the arrangement of administrative units at district and commune levels

The Standing Committees of District and City Party Committees shall lead and direct the People's Committees of districts and cities to guide the People's Committees of communes, wards and towns within the scope of the arrangement to collect voters' opinions (for voters at district and commune-level administrative units directly affected by the arrangement of administrative units) on the arrangement of district and commune-level administrative units according to the provisions of the Law on implementing democracy at the grassroots level, the Law on Organization of Local Government, Resolution No. 35/2023/UBTVQH15 dated July 12, 2023 of the Standing Committee of the National Assembly, Decree No. 59/2023/ND-CP dated August 14, 2023 of the Government detailing a number of articles of the Law on implementing democracy at the grassroots level, Decree No. 54/2018/ND-CP dated April 16, 2018 of the Government guiding the collection of voters' opinions on the establishment, dissolution, merger, division and adjustment of administrative unit boundaries, specifically as follows:

6.1. Establishing and posting the voter list:

Prepare and post the voter list according to the provisions of Decree No. 54/2018/ND-CP dated April 16, 2018 of the Government guiding the collection of voters' opinions on the establishment, dissolution, merger, division, and adjustment of administrative unit boundaries and other relevant legal provisions.

Listing period: From February 15, 2024 to March 15, 2024.

6.2. Organizing voter consultation:

- For districts not subject to the arrangement of district-level administrative units (Gia Vien district, Yen Mo district, Yen Khanh district, Kim Son district), organize the collection of voters' opinions on the content of the project to arrange commune-level administrative units to submit to the People's Councils at commune and district levels for approval.

Implementation time: Completed before March 25, 2024.

- For districts and cities related to the arrangement of district-level administrative units (Hoa Lu district, Ninh Binh city, Nho Quan district, Tam Diep city), simultaneously organize the collection of voters' opinions on the content: Project on arrangement of district-level administrative units and Project on arrangement of commune-level administrative units to submit to the People's Councils at commune and district levels for approval.

Implementation time: Completed before April 30, 2024.

7. The People's Councils at the commune and district levels within the scope of the administrative unit arrangement issue a Resolution approving the Project on the arrangement of administrative units at the district and commune levels for the period 2023-2025.

- For districts not subject to the arrangement of district-level administrative units (Gia Vien district, Yen Mo district, Yen Khanh district, Kim Son district), the People's Councils at the commune and district levels will meet and approve the content of the project to arrange local commune-level administrative units. Implementation time: Completed before March 30, 2024.

- For districts and cities related to the arrangement of district-level administrative units (Hoa Lu district, Ninh Binh city, Nho Quan district, Tam Diep city 7), the People's Councils at commune and district levels meet to approve the content of the project to arrange local commune-level administrative units and the project to arrange related district-level administrative units.

Implementation time: Completed before May 15, 2024.

8. Appraise, synthesize, and develop a master plan for arranging administrative units at district and commune levels; advise the Provincial People's Committee to report to the Provincial People's Committee Party Committee to submit to the Provincial Party Standing Committee.

The Department of Home Affairs shall preside over and coordinate with relevant agencies, units and People's Committees of districts and cities to appraise the dossiers; complete the overall project on arranging administrative units at district and commune levels of the province, period 2023 - 2025, advise the Provincial People's Committee to report to the Party Committee of the Provincial People's Committee to submit to the Standing Committee of the Provincial Party Committee.

Implementation time: Completed before May 30, 2024.

9. Submit to the Provincial People's Council to issue a Resolution approving the Project on arranging administrative units at district and commune levels in Ninh Binh province for the period 2023 - 2025.

The Department of Home Affairs completes the documents and projects, advises the Provincial People's Committee and the Provincial People's Council to consider and issue a Resolution approving the Project to arrange administrative units at district and commune levels in Ninh Binh province for the period 2023 - 2025.

Implementation time: Completed before June 10, 2024.

10. Complete the dossier and project report for appraisal by the Ministry of Home Affairs and relevant Central Ministries and branches.

The Department of Home Affairs shall preside over and coordinate with relevant agencies, units and People's Committees of districts and cities to synthesize and complete documents, procedures and projects for arranging administrative units at district and commune levels in Ninh Binh province, period 2023 - 2025 according to the competent opinions of central agencies, advise the Provincial People's Committee to submit to competent authorities for consideration and decision.

Implementation time: As required by the Ministry of Home Affairs.

12. Implement the Project on arranging administrative units at district and commune levels when approved by the National Assembly Standing Committee.

The Department of Home Affairs advised the Provincial People's Committee to issue a Plan to deploy and organize the implementation of the Resolution of the National Assembly Standing Committee on the arrangement of administrative units at district and commune levels in Nam Du province, period 2023 - 2025.

Implementation time: After the Resolution of the National Assembly Standing Committee (expected to be completed before December 31, 2024).

12.1. Regarding organizational structure:

- For agencies, party organizations, Fatherland Front Committees and socio-political organizations at district and commune levels: follow the instructions of the Central Organizing Committee and competent state agencies.

- For local government organizations and activities of People's Councils and People's Committees at district and commune levels: implement according to the provisions of the Law on Organization of Local Government and Clauses 1, 2, 3, Article 10 of Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee.

- For agencies under the People's Council, specialized agencies under the People's Committee at district level: implement according to the provisions in Clause 4, Article 10 of Resolution No. 35/2023/UBTVQH15.

- For administrative organizations under central agencies, provincial-level agencies organized according to district-level administrative units and other administrative organizations under district-level People's Committees: comply with the provisions of specialized Laws, guiding documents of the Government, of the Ministry managing the sector, field and regulations in Decree No. 158/2018/ND-CP dated November 22, 2018 of the Government.

- For public service units: the arrangement and reorganization of public service units providing the same type of service in the administrative unit's area after the arrangement must ensure that it is consistent with the population size, service radius, and network planning of public service units in the industry and field, ensuring the streamlining of focal points and staffing associated with restructuring and improving the quality of the staff.

- The establishment, reorganization and dissolution of public service units under the district-level People's Committee at the administrative unit after the arrangement shall be carried out in accordance with the provisions of law and instructions of competent authorities (in particular, for public service units in the fields of education and health: for the time being, the current organizational structure shall be maintained and the arrangement shall be carried out after receiving instructions from the provincial People's Committee and instructions from the Department of Home Affairs).

- No later than 30 days from the effective date of the Resolution of the National Assembly Standing Committee on the arrangement of district- and commune-level administrative units in Ninh Binh province, agencies and organizations in the new administrative units must complete the arrangement and consolidation of the organizational apparatus (separation, merger, dissolution, consolidation, conversion or adjustment of functions and tasks of agencies and organizations).

12.2. Regarding the arrangement of cadres, civil servants and public employees:

- The classification, evaluation and arrangement of staff, civil servants, public employees and workers at agencies, organizations and units at district and commune level administrative units formed after the rearrangement must ensure the selection of people with qualities and capacities to take on job positions at new agencies, organizations and units.

- Arrangement of cadres and civil servants of agencies, party organizations, Fatherland Front Committees and socio-political organizations at district and commune levels: implemented according to the instructions of the Central Organizing Committee and competent state agencies.

- Arrangement of cadres and civil servants of administrative agencies and organizations: implemented according to the provisions of Article 11 of Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee, Point b, Clause 7, Section III of the Plan issued with Resolution No. 117/NQ-CP and instructions of the Ministry of Home Affairs.

- From the date the Provincial People's Committee submits to the Government the project to arrange administrative units at district and commune levels in Ninh Binh province, period 2023 - 2025, temporarily suspend the election and appointment of leadership and management positions; temporarily suspend the recruitment and acceptance of cadres, civil servants and public employees in districts, cities and communes, wards and towns subject to the arrangement (from now until the Provincial People's Committee submits to the Government the dossier, project, and arrangement of administrative units, units need to carefully consider the election and appointment of leadership and management positions, the recruitment and acceptance of cadres, civil servants and public employees and must report to competent authorities for comments before implementation).

- No later than 05 years from the effective date of the Resolution of the National Assembly Standing Committee on the arrangement of each administrative unit, the number of leaders, managers and the number of cadres, civil servants, public employees and workers in agencies and organizations at the administrative units after the arrangement must comply with regulations. In special cases, report to the Ministry of Home Affairs for submission to competent authorities for consideration and decision.

12.3. Settlement of regimes and policies for cadres, civil servants, public employees and redundant workers:

- The regime and policies for cadres, civil servants, public employees and workers when implementing the arrangement of administrative units at district and commune levels are implemented according to the provisions of Article 12 of Resolution No. 35/2023/NQ-UBTVQH of the National Assembly Standing Committee.

- Cadres, civil servants, public employees, and redundant workers of agencies and organizations due to the arrangement of administrative units at district and commune levels, depending on each case, are recruited, received, mobilized, and rotated to work at agencies, organizations, and units in the political system according to task requirements or enjoy regimes and policies for retirees, those who quit their jobs, or those who are downsized according to Government regulations.

12.4. Handling of headquarters and public assets:

- Based on the Master Plan for arranging administrative units at district and commune levels, the Department of Finance reviews, makes a list and plans to handle headquarters and public assets of agencies, organizations and units under the management of the Provincial People's Committee, attached to the Project.

- The agencies under the central vertical sector located in the province with subordinate units at the district and commune levels that need to be reorganized shall make a list and plan for the rearrangement and handling of headquarters and public assets under their management. In case there is no need to use them, they shall be transferred to the Provincial People's Committee for reorganization, management and use according to local needs.

- Within 03 years from the effective date of the Resolution of the National Assembly Standing Committee on the arrangement of each administrative unit, the rearrangement and handling of headquarters and public assets of agencies and units at the administrative unit after the arrangement must be completed.

13. Organizing the Ceremony to announce the Resolution of the National Assembly Standing Committee

The Provincial People's Committee and the People's Committees of districts and cities shall organize the Ceremony to announce the Resolution of the National Assembly Standing Committee at the administrative units formed after the arrangement to officially start operating under the new administrative units.

Implementation time: After the National Assembly Standing Committee issues the Resolution on the arrangement of administrative units at district and commune levels in Ninh Binh province, period 2023 - 2025, and the locality organizes the implementation of the Resolution of the National Assembly Standing Committee.

14. Summary of the arrangement of administrative units at district and commune levels in the province for the period 2023 - 2025

The Department of Home Affairs advises the Provincial People's Committee to organize the preliminary review of the arrangement of administrative units at district and commune levels in Ninh Binh province, period 2023 - 2025.

Implementation time: Expected to be completed in the second quarter of 2025.

15. Budget for implementing the arrangement of administrative units at district and commune levels for the period 2023 - 2025

- The state budget allocates funds to implement the arrangement of administrative units at district and commune levels according to the provisions of the law on state budget and current state budget decentralization as prescribed in Clause 1, Article 22 of Resolution No. 35/2023/NQ-UBTVQH of the National Assembly Standing Committee.

- The budget for implementing the arrangement of administrative units at district and commune levels is guaranteed by the local budget according to the provisions of Clause 2, Article 22 of Resolution No. 35/2023/NQ-UBTVQH of the National Assembly Standing Committee.

The central budget provides one-time support to localities receiving additional budget balance support at the rate of 20 billion VND for each reduced district-level administrative unit and 500 million VND for each reduced commune-level administrative unit to support basic construction investment to serve the arrangement of administrative units.

- The Provincial People's Committee submits to the Provincial People's Council for specific decisions on expenditure tasks for the implementation of the arrangement of administrative units at district and commune levels and decides on specific support levels for each administrative unit at district and commune levels to ensure that it is suitable to the actual situation of the locality, complies with the provisions of the State Budget Law and other relevant legal provisions.

III. IMPLEMENTATION ORGANIZATION

  1. Proposal to the Provincial Party Committee's Propaganda Department

Develop a plan to propagate the arrangement of administrative units at district and commune levels for the period 2023 - 2025; direct and orient information and communication agencies and press in the province to widely propagate the contents of resolutions and regulations of the Party, laws of the State and the province on the implementation of the arrangement of administrative units at district and commune levels for the period 2023 - 2025 in the province, in order to create consensus among the entire political system and all classes of people.

Direct and guide the information and communication agencies and press in the province to regularly publish news and articles on the implementation status, results and experiences of relevant localities, units and localities in organizing implementation on the mass media; promptly commend and reward typical and exemplary Party committees, authorities, localities and units in effectively implementing the arrangement of administrative units at district and commune levels.

2. Proposal to the Provincial Party Committee Organizing Committee

Preside over and coordinate with relevant agencies and units to advise the Provincial Party Committee Standing Committee and the Provincial Party Committee Standing Committee on the arrangement and assignment of work for cadres under the management of the Provincial Party Committee Standing Committee; coordinate and guide the Standing Committees of district and city Party Committees to transfer and receive party organizations and party members according to their authority; arrange and assign the payroll of cadres, civil servants and public employees of the Party bloc, the Fatherland Front and socio-political organizations to ensure compliance with regulations; direct and guide the arrangement and consolidation of the organizational apparatus and the settlement of regimes and policies for redundant cadres and civil servants of Party agencies and units, the Fatherland Front Committee and socio-political organizations at administrative units implementing the arrangement. Guide the preparation work for the Congress for the 2025-2030 term for administrative units implementing the arrangement.

3. Proposal to the Standing Committee of the Provincial People's Council

Direct the Standing Committees of the People's Councils at the district and commune levels to submit to the People's Councils at the same level to issue Resolutions on the arrangement of administrative units at the district and commune levels in the area; submit to the Provincial People's Council to issue Resolutions on the arrangement of administrative units at the district and commune levels in the province, Resolutions on resolving regimes and policies for cadres, civil servants, public employees, laborers and part-time workers at the commune level, in villages and residential groups who are redundant after the arrangement of administrative units at the district and commune levels according to regulations.

4. Proposal to the Fatherland Front and provincial socio-political organizations

- Develop plans and programs, promote propaganda and mobilize union members, association members and people of all walks of life to create consensus and high unity in awareness and action, actively implement the policy of arranging administrative units at district and commune levels in localities, agencies and units; promote the role of supervision and social criticism in the process of arranging administrative units at district and commune levels in the area.

- Direct the Fatherland Front Committee and socio-political organizations at district and commune levels to coordinate with relevant agencies to organize the collection of voters' opinions on the Project on arranging administrative units at district and commune levels for the period 2023 - 2025 at administrative units at district and commune levels to ensure democracy and compliance with the provisions of law.

- Coordinate, direct, and guide the arrangement and consolidation of the apparatus and staff of the Fatherland Front Committee and socio-political organizations in localities and units implementing the arrangement, in conjunction with improving the quality and effectiveness of the activities of the Fatherland Front and socio-political organizations at all levels.

5. Provincial departments, branches and sectors

5.1. Department of Home Affairs

- As a standing agency, responsible for advising the Provincial People's Committee and the Provincial Steering Committee to develop and issue documents to organize implementation conferences, review conferences and organize work related to the arrangement of administrative units at district and commune levels in the province.

- Advise the Provincial People's Committee and the Chairman of the Provincial People's Committee to issue documents directing and implementing Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee and Resolution No. 117/NQ-CP of the Government; Provide professional and technical guidance, procedures and processes for preparing dossiers on the arrangement of administrative units at district and commune levels in accordance with the provisions of law, ensuring the set time and progress.

- Preside over and coordinate with relevant agencies, units and localities to develop Plans and Projects for arranging administrative units at the district level; guide localities to develop Plans and Projects for arranging administrative units at the commune level according to regulations; synthesize and develop a master plan, complete the detailed Project for arranging administrative units at the district and commune levels in Ninh Binh province, period 2023 - 2025 to submit to competent authorities.

- Advise and guide on the arrangement and organization of local government apparatus, public service units, and associations; staffing structure, job position list; arrangement and assignment of staff, civil servants, public employees, workers, and part-time workers.

- Preside over and coordinate with relevant agencies to research and advise the Provincial People's Committee to develop support policies for redundant commune-level cadres, civil servants, public employees, workers and part-time workers due to the arrangement of district-level and commune-level administrative units in the period of 2023 - 2025, submit to the Provincial People's Council for consideration and decision, ensuring the time specified in the Plan for implementing the arrangement of district-level and commune-level administrative units in the period of 2023 - 2025 issued together with Resolution No. 117/NQ-CP dated July 30, 2023 issued by the Government.

- Preside and coordinate with the Department of Natural Resources and Environment in preparing various types of status maps, maps of plans for the arrangement of administrative units at district and commune levels and related diagrams to be sent with the Master Plan and Detailed Plan for the arrangement of administrative units at district and commune levels to be submitted to the Ministry of Home Affairs, the Government, and the Standing Committee of the National Assembly. Coordinate with the Department of Planning and Investment in supplementing the content on the arrangement of administrative units at district and commune levels in the provincial planning.

- Preside over the establishment, adjustment and supplementation of records and maps of administrative unit boundaries at all levels related to the arrangement of administrative units at district and commune levels to ensure progress according to regulations after being recognized by the Ministry of Home Affairs for management, storage and exploitation when implementing Project 513 according to Decision No. 513/QD-TTg dated May 2, 2012 and Decision No. 302/QD-TTg dated March 28, 2023 of the Prime Minister.

- Preside over and coordinate with relevant departments, branches and sectors to provide professional and technical guidance, promptly resolve difficulties and problems of localities in the process of implementing the arrangement of administrative units and proactively seek opinions from the Ministry of Home Affairs on issues arising during the performance of tasks.

- Review and report to competent authorities to adjust the quota for district-level cadres, civil servants, public employees, commune-level cadres, civil servants and the number of part-time workers at the commune level, clearly identify the number of district-level cadres, civil servants, public employees, commune-level cadres, civil servants and the number of part-time workers at the commune level in redundant villages and residential groups (including those holding leadership and management positions) to resolve the regime and policies according to the provisions of Article 12 of Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee.

- Guide the People's Committees of districts and cities to consolidate and arrange the organizational apparatus and resolve the regime and policies for cadres, civil servants, public employees, laborers, and specialized workers at the commune level in redundant villages and residential groups in state administrative agencies at district and commune-level administrative units established after the arrangement.

- Preside over and coordinate with relevant agencies to guide the preparation of application dossiers to submit to competent authorities for consideration and recognition of district- and commune-level administrative units formed after the rearrangement as Heroic units of the People's Armed Forces, Labor Heroes, Safe Zone communes, Safe Zone regions...; guide the commendation of collectives and individuals with achievements in implementing Resolution No. 35/2023/NQ-UBTVQH of the National Assembly Standing Committee.

- Develop a budget estimate for the implementation of plans and projects for the arrangement of administrative units at district and commune levels for the period 2023 - 2025 and submit them to competent authorities for approval; monitor, urge and guide agencies, units and localities in implementing the assigned tasks in this Plan to ensure time, progress and periodically summarize reporting results according to regulations.

- Synthesize and advise the Party Executive Committee of the Provincial People's Committee, the Provincial People's Committee to report on the results of organizing and implementing the arrangement of administrative units at district and commune levels in the province according to Resolution No. 16-NQ/TU dated August 23, 2023 of the Provincial Party Executive Committee, Plan No. 138-KH/TU dated August 23, 2023 of the Provincial Party Standing Committee and this Plan to ensure timeliness and compliance with regulations.

5.2. Department of Construction

- Preside over and coordinate with agencies to guide the People's Committees of districts and cities to review, establish, and adjust and supplement urban and rural planning to ensure consistency with the overall plan for arranging administrative units at district and commune levels; advise on reviewing and evaluating urban classification, and assessing the level of infrastructure development for urban administrative units when arranging; advise on reviewing and checking reporting documents before submitting to the Provincial People's Committee.

- Guidelines for implementing urban classification for cities and towns.

5.3. Department of Planning and Investment

- Preside and coordinate with relevant agencies, units and localities to supplement the content of arranging administrative units at district and commune levels in the provincial planning.

- Guidance on the implementation of public investment capital at district- and commune-level administrative units that are being reorganized; the conversion of Enterprise Registration Certificates and Business Registration Licenses of individuals, organizations and enterprises due to changes in boundaries and names of district- and commune-level administrative units after being reorganized; the enjoyment of investment incentives and investment procedures according to the provisions of law on investment in coastal communes in the case of reorganization of administrative units according to regulations.

- Review and report to the Provincial People's Committee to temporarily suspend the approval of investment projects for new construction, repair, renovation, and upgrading of working headquarters at units related to the plan for arranging administrative units.

5.4. Department of Finance

- Advise the Provincial People's Committee to submit to the Provincial People's Council for consideration and decision on specific expenditure tasks for the implementation of the arrangement of district- and commune-level administrative units; decide on specific support levels for each district- and commune-level administrative unit implementing the arrangement; decide on exemption and reduction of fees and charges under the decision-making authority of the Provincial People's Council; decide on adjusting the budget allocation for district-level administrative units after the arrangement.

- Guide relevant agencies, units and localities to prepare budget estimates and expenditure norms; manage, use and settle expenses for implementing the arrangement of administrative units at district and commune levels; handle assets and working offices of agencies and organizations at administrative units at district and commune levels implementing the arrangement.

- Guidance on implementing regulations on exemption of fees and charges when converting related documents of individuals, organizations and enterprises due to changes in administrative boundaries and names of administrative units at district and commune levels.

- Synthesize and appraise the proposed budget estimates of agencies, units and localities (if any) to propose and report to the Provincial People's Committee to arrange funding sources to implement the arrangement of administrative units at district and commune levels according to Article 22 of Resolution No. 35/2023/UBTVQH15 and instructions of the Ministry of Finance; ensure regular funding sources for agencies, units and localities to achieve results.

5.5. Department of Natural Resources and Environment

Provide data on natural area according to land statistics of district and commune-level administrative units as prescribed so that localities can promptly develop overall plans and detailed projects to arrange district and commune-level administrative units.

- Guide the review and adjustment of land records after the arrangement of district- and commune-level administrative units due to changes in administrative boundaries and names of district- and commune-level administrative units after the arrangement; coordinate with relevant agencies, units and localities to arrange land funds to build working offices after the arrangement of district- and commune-level administrative units; monitor, grasp the situation, inspect, urge and guide the review of planning and land use plans for district- and commune-level administrative units subject to arrangement.

- Coordinate the development of various types of status maps, maps of plans for arranging administrative units at district and commune levels and related diagrams to submit with the Master Plan, Project for arranging administrative units at district and commune levels to the Ministry of Home Affairs, the Government, and the National Assembly Standing Committee; provide information, measurement data and maps within the scope of management to relevant agencies, units and localities to serve the arrangement of administrative units at all levels upon request.

- Coordinate with the Department of Home Affairs to establish new, edit, and supplement records and maps of administrative unit boundaries at all levels related to the arrangement of administrative units at district and commune levels to ensure progress according to regulations after being recognized by the Ministry of Home Affairs for management, storage, exploitation and use when implementing Project 513 according to Decision No. 513/QD-TTg dated May 2, 2012 and Decision No. 302/QD-TTg dated March 28, 2023 of the Prime Minister.

5.6. Provincial Police

- Provide actual population data residing at district and commune level administrative units so that relevant agencies, units and localities have a basis to develop plans and projects to arrange district and commune level administrative units.

- Guide and implement the collection of old seals and engraving of new seals of agencies and organizations at district and commune-level administrative units to be arranged; the change of residential address of citizens due to changes in boundaries and names of district and commune-level administrative units.

- Preside over and coordinate with the Military Command, the Provincial Border Guard, relevant units and localities to develop and effectively implement plans to ensure political security, social order and safety; ensure absolute safety for the work of arranging administrative units at district and commune levels and the work of organizing public opinion collection in localities implementing the arrangement of administrative units.

5.7. Provincial Military Command

Guide agencies, units and localities to organize militia and self-defense forces at district and commune-level administrative units after the arrangement of administrative units; coordinate with the Provincial Police, Provincial Border Guard, relevant units and localities to develop and effectively implement plans to ensure political security and social order and safety in districts and cities during the arrangement of district and commune-level administrative units; ensure absolute safety for the arrangement of district and commune-level administrative units.

5.8. Border Guard Command

Monitor, grasp the situation, inspect and urge the implementation of state regulations on ensuring political security and social order and safety in the arrangement of administrative units at district and commune levels; coordinate with the Provincial Military Command, Provincial Police and relevant units and localities to develop and effectively implement plans to maintain political security and social order and safety, and ensure absolute safety for the arrangement of administrative units at district and commune levels.

5.9. Department of Information and Communications

- Preside and coordinate with departments, branches and localities to provide information to press agencies to effectively carry out propaganda work to create consensus among the entire political system, branches, levels, cadres, civil servants, public employees, workers and people in implementing the arrangement of administrative units at district and commune levels.

- Direct press agencies to proactively coordinate with localities to regularly inform about achieved results, good examples, things that have not been done, causes, especially subjective causes, solutions and valuable lessons, good practices in implementing the arrangement of administrative units at district and commune levels.

5.10. Department of Agriculture and Rural Development

- Guide the review and supplement of policies according to the National Target Program on New Rural Construction for the period 2021-2025 at district and commune-level administrative units implementing the arrangement.

- Guide and submit to competent authorities for recognition of administrative units at district and commune levels established after the arrangement to meet new rural standards, advanced new rural standards, and model new rural standards.

5.11. Department of Justice

Provide guidance on the application of laws, disseminate and popularize laws on registration of security measures when implementing changes in boundaries and names of district- and commune-level administrative units that are being rearranged; provide guidance on the implementation of registration and management of household registration for administrative units formed after the rearrangement.

5.12. Department of Labor, War Invalids and Social Affairs

Guide to review and report to competent authorities for consideration and adjustment of the implementation of regimes and policies according to the National Target Program at district and commune-level administrative units established after the rearrangement; guide to review and adjust policies in the field of labor - social affairs and policies for meritorious people at district and commune-level administrative units implementing the rearrangement.

5.13. Department of Culture and Sports

Guidance on reviewing, adjusting and implementing the identification of recognized and ranked relics as world cultural and natural heritage or special national historical relics at district and commune-level administrative units formed after the rearrangement.

5.14. Office of the Provincial People's Committee

- Coordinate with the Department of Home Affairs to advise the Party Committee of the Provincial People's Committee, the Provincial People's Committee to issue leadership and direction documents, organize conferences to implement tasks related to the arrangement of administrative units at district and commune levels.

- Closely coordinate with the Department of Home Affairs and relevant agencies, units and localities to promptly report to competent authorities to consider and resolve problems and difficulties in the implementation of the arrangement of administrative units at district and commune levels.

5.15. Provincial Inspectorate

Preside over and coordinate with relevant agencies, units and localities in resolving complaints and denunciations of people and organizations related to the arrangement of administrative units at district and commune levels (if any).

5.16. Departments, agencies and branches

- Based on the functions and tasks of agencies, units and instructions of specialized ministries and branches, proactively research, guide, monitor and grasp the situation, inspect and urge the organization and implementation of the arrangement of administrative units at district and commune levels in the province according to regulations.

- Organize the review, establishment and adjustment of relevant technical and specialized plans according to regulations, ensuring timeliness and suitability.

6. People's Committees of districts and cities

- Develop a plan to implement the arrangement of administrative units at district and commune levels in the area for the period 2023 - 2025.

- Develop plans and projects to arrange administrative units at district and commune levels in the area for the period 2023 - 2025, complete the dossier and send it to the Department of Home Affairs to synthesize and develop the overall plan and detailed project to arrange administrative units at district and commune levels in Ninh Binh province for the period 2023 - 2025 to submit to competent authorities for consideration and decision.

- Direct, guide and inspect the People's Committees of relevant communes, wards and towns in organizing the collection of voters' opinions; be responsible for the results of the collection of voters' opinions; synthesize the results of the collection of voters' opinions in the area to report to the Provincial People's Committee (through the Department of Home Affairs for synthesis) and the People's Councils at the same level.

- Submit to the District People's Council to issue a Resolution approving the project to arrange administrative units at district and commune levels in the area for the period 2023 - 2025.

- Based on the direction of the Provincial People's Committee and the guidance of the Department of Home Affairs, direct the communes, wards and towns directly under the province to arrange the organizational structure, arrange the staff, civil servants, public employees and workers at the administrative units after the arrangement; resolve the regime and policies for the redundant subjects due to the arrangement of administrative units.

- Review and report to the Provincial People's Committee (through the Department of Home Affairs) on the staffing quota and current status of using district-level cadres, civil servants, public employees, commune-level cadres, civil servants and the number of part-time workers at the commune level; clearly identify the number of district-level cadres, civil servants, public employees, commune-level cadres, civil servants and the number of part-time workers at the commune level in redundant villages (hamlets), residential groups (including those holding leadership and management positions) to resolve the regime and policies according to the provisions of Article 12 of Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee.

- Develop a plan to propagate and implement the conversion of documents for individuals and organizations, creating favorable conditions for individuals and organizations when carrying out procedures for converting documents, fees and charges when converting due to changes in administrative unit boundaries according to regulations.

- Organize the review, establishment and adjustment of plans under the authority and responsibility of the locality to ensure timeliness and consistency with the overall plan for arranging administrative units at district and commune levels.

- Lead and direct the People's Committees of communes, wards and towns:

+ Direct and guide the preparation of voter lists in the area at the time of organizing the opinion collection; Decide on the distribution of ballots to collect voters' opinions in communes, wards and towns in accordance with the characteristics of residential areas in the area; organize the collection of voters' opinions in each village (hamlet), residential group; synthesize the results of the collection of voters' opinions in the area to report to the People's Committee of the district or city.

+ Submit to the People's Council at the commune level to issue a Resolution approving the project to arrange administrative units at the commune level in the period of 2023 - 2025. Particularly for Hoa Lu district, Ninh Binh city, Nho Quan district, Tam Diep city, the People's Committee at the commune level submits to the People's Council at the same level to approve the content of the project to arrange administrative units at the commune level and the project to arrange administrative units at the district level in the period of 2023 - 2025.

+ Report to the District People's Committee on the current status of using the commune-level staff and civil servants and the number of redundant non-professional workers at the commune level, in villages (hamlets), and residential groups (including those holding leadership and management positions) to resolve the regime and policies according to the provisions of Article 12 of Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee.

+ Create conditions for people in their daily life and transactions at newly established administrative units after arranging and converting documents for people and businesses according to authority.

During the implementation process, agencies, units and localities shall proactively synthesize difficulties and problems (if any), report in writing and propose solutions to the Provincial People's Committee and the Department of Home Affairs.
