Thorough review

Next week, June 17 is the deadline for comments and recommendations to develop a report recommending the abolition and amendment of regulations related to production and business activities that are causing difficulties for businesses of the Vietnam Federation of Commerce and Industry (VCCI).

Mr. Dau Anh Tuan, Deputy General Secretary, Head of the Legal Department of VCCI, said that this plan to collect business opinions was thoroughly implemented by VCCI right after Resolution 68-NQ/TW on private economic development was issued on May 4, 2025. Previously, when the Government issued Resolution 66/NQ-CP on the Program to reduce and simplify administrative procedures related to production and business activities in 2025 and 2026 in March 2025, the review of business regulations was also initiated.

Not only VCCI is rushing to compile and complete a report reflecting the business perspective on business regulations to send to Party, Government and National Assembly agencies. In the past few days, the Ho Chi Minh City Real Estate Association (HoREA) has continuously sent documents to its members requesting early amendments to Article 50 and Article 51 of Decree 103/2024/ND-CP regulating "the amount of money that land users must pay additionally for the period not yet calculated for land use fees and land rent", contributing comments to the Draft Decree detailing projects applying BT contracts...

“Ministries and sectors are urgently reviewing and amending legal documents to implement policies in the resolutions. This is also an opportunity for businesses to reflect on difficulties and inadequacies of regulations related to business. We have received many opinions, clearly naming the difficulties, identifying where they lie, in which clauses, in which documents,” said Mr. Tuan.

Waiting for decisions soon

Reviewing problems and making recommendations for solutions is a regular activity of associations. However, the goal that businesses and business associations hope for this time is that the problems will be resolved soon and completely.

In the May and 5-month socio-economic situation report sent to the Government at the regular meeting, the Ministry of Finance also identified reporting to the Government in June proposals on specific tasks and solutions to improve the business environment and enhance national competitiveness.

According to the Ministry of Finance's assessment, the completion of institutions and laws has been given attention and direction, but there are still problems; administrative procedures are still cumbersome and complicated, including unclear and unreasonable regulations and conditions, which have been recommended by associations, businesses and management agencies for many years.

In the May and 5-month socio-economic situation report sent to the Government at the regular meeting, the Ministry of Finance also identified reporting to the Government in June proposals on specific tasks and solutions to improve the business environment and enhance national competitiveness.

A number of specific examples have been mentioned, such as regulations on the use of imported seafood raw materials and testing for banned antibiotics in seafood (Decree 37/2024/ND-CP). Some standards, regulations, and specialized inspection regulations on food safety and quarantine are still overlapping, complicated, not in harmony with international practices, and have not been digitized and implemented entirely on the national single window portal...

In particular, the management of machinery imports based on equipment age (10 years) without basing on technological criteria and standards (Decision No. 28/2022/QD-TTg amending Decision No. 18/2019/QD-TTg dated April 19, 2019) continues to be mentioned, when the Ministry of Finance has sent a document to the Ministry of Science and Technology since 2021, requesting to review and consider abolishing regulations on management based on equipment age, instead applying regulations on import criteria and standards in the direction of improving the quality of imported machinery...

Reporting to the Government, the Ministry of Finance said that the above problems need to be reviewed and thoroughly resolved soon to promote the export of key industries of our country such as seafood, machinery, high-tech equipment, etc. and develop domestic supply chains of enterprises.

Administrative system moves from licensing to registration

What businesses and experts expect from solutions to solve business problems is not only speed, but also the implementation method. Mr. Dau Anh Tuan mentioned the shift from licensing to registration, which the Prime Minister is urging ministries and branches to apply in solutions to reduce administrative procedures and business conditions.

However, things will not change overnight. “These changes will take time, because moving from a pre-control to a post-control mechanism will not only change the focus of management, but also change the role and responsibility of state management agencies. In addition, the supervisory role of the community, associations, and businesses must also change, requiring more responsibility,” Mr. Tuan emphasized.

In the immediate future, there are recommendations to clarify procedures and processes, and especially to properly implement regulations on processing time limits of state management agencies. Mr. Nguyen Ba Hung, Chief Economist of the Asian Development Bank (ADB), said that this is what businesses really need in order to proactively plan their business.

“For businesses, it is important that the business environment is stable and predictable, so that they can plan their operations. Many businesses even think that high costs are okay, because when the business operates well, they can cope with the costs, they just need to determine how long they need to wait when applying for permits, doing administrative procedures...,” Mr. Hung analyzed.

That is why Mr. Hung proposed that, in addition to the principle that all administrative procedures must have a clear deadline for resolution, it is necessary to add a requirement that if there is no response after that deadline, the enterprise's plan will be accepted by default. At that time, the enterprise will comply with the provisions of the law and the state management agency will conduct a post-audit. This is the basis for the post-audit mechanism to be operated in a public and transparent manner.
