Proposal to issue and change ID cards online due to administrative unit arrangement

The Ministry of Public Security recommends that people who want to correct information on their ID cards due to changes in administrative boundaries after the merger can do so online on the public service portal.

The information is stated in the appraisal dossier of the draft Law amending and supplementing a number of articles of 10 Laws related to security and order, drafted by the Ministry of Public Security. In which, the Ministry of Public Security proposed to amend and supplement many clauses of 8 articles of the Law on Identification.

Current law stipulates that after the merger of provincial administrative units, citizens are not required to change to a new ID card. The ID card currently in use is still valid according to the expiration date stated on the card. However, citizens who need to change to a new ID card can still do so, such as when they reach the age of 14, 25, 40, and 60.

In the draft amendment to the Law on Identification, the Ministry of Public Security proposed that anyone who wants to renew their identification card when the information on the card changes due to administrative unit arrangement will do so online on the public service portal and national identification application. This is to ensure compliance with reality and create favorable conditions for the people.

In addition to online issuance and renewal, the Ministry of Public Security maintains the form of direct issuance request at the place where the ID card issuance procedures are carried out. Accordingly, when there is a request, the ID management agency uses information on the most recently collected facial photo, fingerprint, iris and existing documents in the database to reissue.

If passed, this will be a new point, as the current Law on Identification (effective from July 1, 2024) only allows people who have lost their ID cards or damaged cards to be reissued online on the public service portal.

In the draft, the Ministry of Public Security also proposed that in case the person granted an electronic identification card has presented it upon request, the agency or organization shall not be required to present documents or provide information that has been integrated into the electronic identification card.

The Ministry of Public Security explained that this change was necessary because the law stipulates the value of electronic identification but it is not enough, leading to many agencies, organizations and individuals still requiring citizens to present documents or provide information that has been integrated into the electronic identification. This reduces the value of integrating information into the electronic identification.

Proposal to remove the regulation "only allowed to drive 48 hours per week"

According to the Ministry of Public Security, the amendment of 10 laws on administrative management related to the activities, functions and tasks of the police force is to be consistent with the process of restructuring and organizing the apparatus. Amending 10 laws in one law is also consistent with the Law on promulgation of legal documents, when implemented in a shortened order.

Among the proposed amendments is the Law on Traffic Order and Safety (effective from the beginning of this year). The Ministry of Public Security proposed to amend the law to remove the rigid regulation that drivers of commercial vehicles are only allowed to drive 10 hours per day and 48 hours per week. This should be done in accordance with the provisions of the Labor Code.

Only continuous driving time remains the same at no more than 4 hours.

According to the police, this proposed amendment is based on recommendations from the Vietnam Automobile Transport Association and transport businesses. The recommendations show that the law's regulations on driving hours during the week and continuous driving are not consistent with the general regulations of some countries in the region and cause difficulties for transport activities and driver arrangement of businesses.

This draft also proposes to add regulations that transport business vehicles must install a device to record the driver's image; internal transport vehicles must install a journey monitoring device and a device to record the driver's image; passenger vehicles with 8 seats or more when doing transport business must install a device to record the image of the passenger compartment.

Such regulations, according to the drafting agency, aim to ensure that means of transport business and internal transport vehicles are managed more closely, serving the work of preventing and detecting violations of order on road vehicles.

The draft also proposes to add a regulation that a person who is granted a driving license and commits fraudulent acts to obtain, change, or reissue a license will have his/her license revoked.

Under current law, commercial vehicle drivers are allowed to drive no more than 10 hours per day and no more than 48 hours per week. They are also prohibited from driving continuously for more than four hours.
