A man surnamed Yao, in his 40s, who works as a water delivery man and earns only $400 a month in Xi'an, China, won a $1.4 million lottery jackpot in 2019.
Accordingly, on July 17, 2019, Yao transferred $2.8 to a lottery store owner surnamed Wang, asking him to pick two lottery tickets for him. Wang randomly picked two tickets and sent Yao a photo via a social media platform to confirm the purchase. That same evening, one of the tickets Yao bought won the jackpot prize of $1.4 million.
However, when Yao went to the store to receive the tickets and redeem the prizes, Wang said that someone else had actually bought the two lottery tickets and that he had mistakenly sent Yao a photo of the lottery tickets.
Wang agreed to pay Yao $20,000 (nearly VND500 million) as mental compensation. Yao agreed to give Wang his mobile phone to delete all chat history after receiving the money.
Two months later, Yao discovered that it was Wang's cousin, Gao, who went to the lottery office to claim the ticket, not someone else as Wang said.
Gao received $1 million (more than VND23 billion) from the Shaanxi Provincial Lottery Management Center in September 2019, after tax was deducted from the lottery prize.
What is the court's ruling?
Yao then filed a lawsuit against Wang. The court ruled that Gao must return the prize to Yao and that Wang must be jointly responsible for making the return.
Gao appealed, and in July this year, the Xi'an Intermediate People's Court upheld the original verdict because there was no evidence to prove Gao purchased the ticket.
Despite winning the case, Yao said he was not satisfied. "The court froze their bank accounts, but there was no money in them. I did not receive a single cent from them," he said.
Wang and Gao's houses have also been put up for auction but have so far gone unsold.
"Before the incident, I lived an ordinary life. After the incident, I spent all my savings and borrowed hundreds of thousands of yuan to hire a lawyer. How could I not worry about my life?" Yao said.
Yu Shengxiu, Yao's lawyer, said the two are planning to file a lawsuit asking the authorities to investigate where the lottery winnings are hidden.
