Regarding the case of the Chairman of the People's Committee of Huong Hoa District ( Quang Tri ) still signing the decision to appoint the principal for a third term even though the District Party Committee said no, the Chairman of the District affirmed that he had made no mistake in his appointment. However, the Huong Hoa District Party Committee also provided grounds to argue that he was right in not agreeing to the appointment.
“I have no personal interests.”
Responding to Tuoi Tre Online , Mr. Tran Binh Thuan , Chairman of the People's Committee of Huong Hoa district, said that he was not wrong when he signed the decision to appoint the principal of Xy Kindergarten for a third term, even though this person had previously been the principal there for two consecutive terms.
According to Mr. Thuan, in his appointment decision, he cited Decree 85/2023 on recruitment, use and management of civil servants. “This Decree stipulates that administrative officials can be reappointed an unlimited number of times to hold a management position. Therefore, the case of appointing this principal for a third term is not against the regulations,” Mr. Thuan affirmed.
Mr. Thuan also said that if the District Party Committee does not agree, "we will transfer the principal of this school to another school, to neighboring schools. This usually takes at least half a month, because to transfer this person, we must also transfer the principal of the other school."
"I have no personal interest in this matter," Mr. Thuan affirmed.
Decree 85 has a section "except in cases"
Meanwhile, the leader of Huong Hoa District Party Committee said that the District Party Committee received the document requesting opinions on August 2. Immediately after that, the District Party Committee had its affiliated professional agencies review the regulations and found that this appointment was incorrect because the principal had been at the same school for two consecutive terms.
Therefore, on August 13, the District Party Committee sent a written response to the District People's Committee to convey its disagreement with the reappointment and the need for transfer.
“Actually, the District People’s Committee should have asked for opinions 30 days before the appointment date. But this was only 13 days, including holidays. We had to work quickly to respond to the District People’s Committee before the appointment deadline,” said the leader of the Huong Hoa District Party Committee.
Regarding this, a leader of the Department of Home Affairs of Quang Tri province said that it is true that Decree 85/2023 has amended a number of articles compared to the previous decree on the use and management of civil servants.
Specifically, this decree does not limit the number of reappointments for management officials.
However, this unlimited appointment provision includes an exclusion.
“A manager can be reappointed an unlimited number of times to hold a management position, except in cases where there are other regulations of the Party or specialized laws,” the leader of this department explained.
According to this leader's analysis, theeducation sector has a circular No. 52, issued in 2020. This circular clearly stipulates the appointment of principals and vice principals. Accordingly, after 5 years, the principal is evaluated and can be reappointed. However, this circular stipulates that the principal working at a public school cannot serve more than two consecutive terms.
“In this case, Circular 52 is the “specialized law” that is included in the exclusion situation in Decree 85. That is, the regulation does not limit the number of times it does not count when it is the principal of a public school. Therefore, this reappointment is wrong,” the leader of the Department of Home Affairs affirmed.
