Teachers are prohibited from forcing extra classes in any form.

The Law on Teachers clearly stipulates what teachers are not allowed to do, including not forcing students to participate in extra classes in any form. The issue of extra teaching and learning was of great concern to National Assembly deputies when discussing this draft law at the 9th session.

Mr. Nguyen Dac Vinh, Chairman of the National Assembly's Committee on Culture and Society, said there were suggestions to add the concept of "extra teaching" and regulations on the management of extra teaching and learning to improve the quality of teaching and learning in schools.

There are suggestions that the Government should develop a set of regulations on extra teaching and learning and prohibit teachers from giving extra teaching in violation of the law; and propose to prohibit teachers from giving extra teaching to students they are directly teaching.

Regarding this issue, the National Assembly Standing Committee stated that the management of extra teaching and learning is within the scope of the Lawon Education and will be specifically regulated in the implementing guidance document.

The draft law does not prohibit extra teaching and learning, it only stipulates that teachers are not allowed to force students to participate in extra learning in any form in order to limit and overcome the widespread situation of extra teaching and learning and profiteering from extra teaching and learning activities.

According to Mr. Nguyen Dac Vinh, currently, the Ministry of Education and Training (MOET) has issued a document regulating extra teaching and learning, which clearly states that teachers are prohibited from giving extra lessons to students they are directly teaching.

Previously, speaking at the 46th session of the National Assembly Standing Committee, Ms. Nguyen Thanh Hai, Chairwoman of the National Assembly Delegation Affairs Committee, affirmed that extra teaching and learning is a legitimate need, but the core is that profiteering from this activity is not allowed.

According to Ms. Nguyen Thanh Hai, although the Ministry of Education and Training has issued a circular with detailed instructions, in reality there are still many variations in extra teaching and learning. Currently, there are three popular forms of extra teaching: at home, at the center and online via platforms such as Zoom or Google Meet. Of these, online extra teaching and fee collection are very difficult to control.

Ms. Nguyen Thanh Hai also pointed out the situation where some teachers "force" parents to voluntarily write applications for their children to take extra classes, even though the draft law strictly prohibits forcing students to participate in extra classes in any form. Therefore, she proposed that the draft should add clearer regulations to prevent profiteering from extra classes.

Article 11. Things not to do

1. Teachers in public educational institutions are not allowed to do things that civil servants are not allowed to do according to the provisions of the law on civil servants and other relevant legal provisions. Teachers in non-public educational institutions are not allowed to perform acts prohibited in the field of labor according to the provisions of the law on labor and other relevant legal provisions.

2. In addition to the provisions in Clause 1 of this Article, teachers are not allowed to do the following:

a) Discrimination among learners in any form;

b) Fraud, intentionally falsifying results in enrollment activities and student assessment;

c) Forcing students to participate in extra classes in any form;

d) Forcing students to pay money or material beyond the provisions of law;

d) Taking advantage of the title of teacher and professional activities to commit illegal acts.
