Procedures for granting Food Safety Certificates to agricultural, forestry and fishery production establishments

Certificate of food safety eligibility for establishments producing and trading agricultural, forestry and fishery products is valid for 03 years from the date of issue.

This Circular provides for decentralization of state management in the field of agricultural, forestry and fishery product quality management, including:

Detailed regulations and instructions for the implementation of Decree No. 136/2025/ND-CP dated June 12, 2025 of the Government regulating decentralization and delegation in the fields of agriculture and environment.

Amending and supplementing a number of articles of legal documents under the promulgation authority of the Minister of Agriculture and Environment to implement decentralization of state management in the field of quality management of agricultural, forestry and fishery products.

Granting of Certificate of food safety eligibility for establishments producing and trading agricultural, forestry and aquatic products

The Circular clearly states that the application for a Certificate of food safety eligibility for establishments producing and trading agricultural, forestry and aquatic products is stipulated in Clause 1, Article 36 of the Law on Food Safety, specifically as follows:

Application for Certificate of food safety qualified facility.

Copy of Business Registration Certificate.

Description of facilities, equipment and tools to ensure food hygiene and safety conditions.

Health certificate of the owner and the person directly producing and trading food issued by a qualified medical examination and treatment facility.

Certificate of training in food safety and hygiene of the owner of the facility and of the person directly producing and trading food according to regulations.

Procedure

Organizations and individuals submit 01 set of documents to apply for a Certificate of food safety qualified facility to the specialized agency assigned by the Chairman of the Provincial People's Committee to receive the documents (called the document receiving agency) directly or online or via postal service.

The agency receiving the dossier shall immediately respond to the completeness of the dossier in case of direct submission; and respond to the completeness of the dossier within 01 working day in case of submission via the internet or postal service in writing.

The specialized agency assigned by the Chairman of the Provincial People's Committee to handle administrative procedures (called the competent agency) shall check the completeness and validity of the dossier and notify the facility of the results and the expected date of appraisal in case the dossier is valid; or notify the dossier of non-compliance and state the reason.

Within 15 days from the date of receipt of valid documents:

The competent authority shall issue a Decision to establish an appraisal team immediately after receiving notification of valid documents. The appraisal team shall announce the decision to establish the team, clearly stating the purpose and content of the appraisal. After receiving the appraisal report from the appraisal team, the competent authority shall verify the report (requesting the appraisal team to explain the assessment contents if necessary).

Issuance of a Certificate of food safety qualified facility according to the form in Appendix V of Circular No. 17/2024/TT-BNNPTNT in the following cases:

The facility meets the requirements for food safety conditions and has satisfactory test results in case of sampling during the assessment process.

In case the test sample results do not meet food safety regulations, the issuance of the Certificate will only be carried out after the facility investigates the cause, takes remedial measures and is inspected by a competent authority and found to meet the requirements.

In case the facility has an unsatisfactory appraisal result but has a corrective report and is assessed by the appraisal team as satisfactory within the time limit for granting the Certificate, the competent authority shall examine and grant the Certificate.

In case the assessment result is not satisfactory and the facility does not correct the problem within the required time limit, the competent authority shall issue a notice of assessment result, not issue the Certificate, and send it to the local food safety management agency for supervision and the facility shall not be allowed to operate.

The certificate is valid for 03 years from the date of issue.
