Regarding violations of construction order in Thach That district ( Hanoi city), including a 9-storey building with nearly 150 illegal apartments (in Tan Xa commune) that the press has reported in recent days, the Department of Construction Inspectorate is currently working with the Thach That district government to clarify the violations and handle them according to the direction of the Chairman of the Hanoi People's Committee.
A responsible official of the Hanoi Department of Construction said that handling construction violations of this 9-story building is under the authority of the Chairman of the People's Committee of Thach That district.
This person said that according to Decision 04 on Regulations on construction order management in Hanoi, the city assigned the People's Committees of districts and towns to be responsible for comprehensive management.
If a violation occurs, the highest responsibility for managing construction order in the locality belongs to the Chairman of the District People's Committee. For the violation of construction order at the 9-storey building in Tan Xa commune, the Chairman of the Thach That District People's Committee bears full responsibility.
This project is licensed for 3 floors + attic. Of which, the construction area of the first floor is more than 150 m2.
Responding to the press, Mr. Nguyen Minh Hong - Chairman of the People's Committee of Thach That District (Hanoi City), affirmed that this project is illegal and will be handled as an example for other projects. However, the head of the Thach That District government did not say specifically how strict the handling will be.
According to the Chairman of the People's Committee of Thach That district, this violation was primarily due to the civil servants and the agencies assigned with authority not fulfilling their responsibilities. The district has established inspection teams and has issued conclusion No. 13 to consider and discipline a number of commune-level officials. Next week, the district will take disciplinary action against the Chairman, Vice Chairman, land and professional officials of the commune who violated the law.
The Chairman of the People's Committee of Thach That district has not yet informed whether he or any leader of Thach That district will be held responsible for a series of illegal constructions in the district.
According to Nguoi Dua Tin 's investigation, construction permit No. 32 signed by Mr. Nguyen Kim Loan - Vice Chairman of Thach That District People's Committee for Mr. VMC and Ms. NTQH (residing in Viet Hung Ward, Long Bien District) shows that this is a private housing project, on plot No. 152, map sheet No. 14 (village 1, Tan Xa Commune). The plot of land has an area of 726.5 m2.
Although there was no construction permit, the investor still built and was fined. The People's Committee of Thach That district later granted a construction permit to the investor with a construction scale of 3 floors, 1 attic; construction density of only 20.7%; height of only 15.6 m from the current road surface.
However, the investor later built 9 floors with nearly 150 apartments, the construction density almost covered more than 700 square meters. Thach That district later revoked the construction permit. Currently, this building does not have a permit.
Transfer to the investigation agency if there are signs of criminality
Previously, regarding this project, Chairman of Hanoi People's Committee Tran Sy Thanh requested the Department of Construction to preside over and coordinate with the Office of the City People's Committee and the People's Committee of Thach That district to inspect and clarify; consider the responsibility of collectives and individuals (if any) according to Directive No. 24 dated August 7, 2023 of the Standing Committee of the City Party Committee "On strengthening discipline, discipline and responsibility for handling work in the City's political system"; in case there are signs of criminal law violations, transfer to the investigation agency for handling according to authority .
