The Ministry of Health regulates the authority to decide on social allowance payment and suspension of social allowance.
Implement regulations on professional standards for social work collaborators at the commune level
According to the Circular, the authority to perform the tasks specified in Clause 2, Article 6 of Circular No. 07/2013/TT-BLDTBXH dated May 24, 2013 of the Minister of Labor, War Invalids and Social Affairs stipulating professional standards for social work collaborators in communes, wards and towns is performed by the Chairman of the People's Committee of the commune, ward and special zone (commune level).
Establishment, dissolution of volunteer social work teams and approval of operating regulations
The authority to decide on the establishment and dissolution of the Volunteer Social Work Team (Volunteer Team) is stipulated in Article 6 and to approve the operating regulations stipulated in Clause 1, Article 10 of Joint Circular No. 24/2012/TTLT-BLDTBXH-BNV-BTC dated October 22, 2012 of the Minister of Labor - Invalids and Social Affairs, the Minister of Home Affairs, and the Minister of Finance regulating the establishment, dissolution, organization of activities and policies for the Volunteer Social Work Team in communes, wards and towns is implemented by the Chairman of the People's Committee at the commune level.
The procedures and implementation order are as follows: Based on the situation and practical requirements of social evil prevention and control work in the management area, the Chairman of the People's Committee at the commune level shall consider and decide to establish a Volunteer Team and approve the Volunteer Team's Operating Regulations.
In case of change of Volunteer Team members, the Chairman of the People's Committee at the commune level decides to change the Volunteer Team members.
Based on the practical situation of social evil prevention and control in the locality, the Chairman of the People's Committee at the commune level decides to dissolve the Volunteer Team.
Decision to temporarily suspend social benefits
According to the Circular, the authority to decide to temporarily suspend monthly social allowances and monthly support for care and nurturing expenses is stipulated in Clause 4, Article 2 of Circular No. 02/2021/TT-BLDTBXH dated June 24, 2021 of the Minister of Labor - Invalids and Social Affairs guiding the implementation of a number of articles of Decree No. 20/2021/ND-CP dated March 15, 2021 of the Government regulating social assistance policies for social protection beneficiaries is implemented by the Chairman of the People's Committee at the commune level.
Regarding the implementation procedures, according to the Circular, the Chairman of the People's Committee at the commune level shall, based on the provisions of Clause 3, Article 2 of Circular No. 02/2021/TT-BLDTBXH, consider and decide to temporarily suspend monthly social allowances and support monthly care and nurturing expenses.
In addition, the Circular also clearly states that the authority to organize the implementation of guidance and training on professional skills for receiving care and nurturing of social protection beneficiaries in the community as prescribed in Clause 2, Article 4 of Circular No. 02/2021/TT-BLDTBXH is implemented by the Chairman of the People's Committee at the commune level.
Decision on payment of social allowances, monthly support for care and nurturing expenses at corresponding levels
According to the Circular, the authority to decide on payment at the corresponding level prescribed in Clause 1, Article 5 of Circular No. 02/2021/TT-BLDTBXH is exercised by the Chairman of the People's Committee at the commune level.
This Circular takes effect from July 1, 2025 and expires from March 1, 2027./.
