Strengthening the fight against commercial fraud, counterfeit goods and intellectual property infringement

In recent times, functional forces in Ninh Thuan province have implemented synchronous solutions to prevent smuggling, trade fraud, counterfeit goods and infringement of intellectual property rights (IPR), contributing to protecting consumer rights, maintaining market stability and a healthy business environment.

Currently, the province has more than 4,600 registered enterprises and nearly 34,000 individual business households, of which about 1,000 enterprises are engaged in commodity production. Most of the enterprises are small and micro-sized, mainly producing by manual methods with items such as agricultural products, seafood, bird's nests and bird's nest products..., which are mainly consumed through social networks and e-commerce platforms. In recent times, the situation of smuggling, trade fraud, counterfeit goods and infringement of intellectual property rights in the province continues to be complicated. Although not a key area like border provinces and border gates, with a large terrain, many inter-district and inter-provincial traffic routes, bordering Khanh Hoa, Binh Thuan , Lam Dong..., Ninh Thuan is still a transit point and consumption point for smuggled goods and goods of unknown origin brought in from other places. In addition, the rapid development of e-commerce and sales via social networks has posed many challenges for inspection and control. The infringement of intellectual property rights is also on the rise, mainly due to the illegal use of trademarks and industrial designs for profit...

This requires the authorities to proactively grasp the situation and strengthen coordination to promptly detect and prevent. Especially implementing the Prime Minister 's direction on launching a peak period to fight against smuggling, trade fraud and counterfeit goods, infringement of intellectual property rights and Directive No. 13/CT-TTg dated May 17, 2025 of the Prime Minister on strengthening the fight against smuggling, trade fraud and counterfeit goods in the new situation; the Provincial Steering Committee 389/DP has urgently studied the content, based on the actual situation in the area and deployed it to the members of the Steering Committee to ensure timeliness, strictness, suitability, effectiveness and compliance with regulations. At the same time, direct the provincial Market Management force to preside over and coordinate with relevant agencies to strictly handle acts of smuggling, trade fraud, counterfeit goods, goods of unknown origin, and infringement of intellectual property rights in the area, paying special attention to violations in the e-commerce environment, especially in remote areas. On the other hand, enhance propaganda and dissemination of laws so that people do not participate in or assist in acts of smuggling, illegal transportation of goods, and production and trade of counterfeit goods.

As a result, in the first 5 months of the year, 151 cases were detected, including 148 administrative violations and 3 criminal prosecutions. The total amount collected during the period was over 3.5 billion VND. In particular, the inspection and handling of the peak month according to Official Dispatch No. 65/CD-TTg dated May 15, 2025 of the Prime Minister (from May 15, 2025 to June 15, 2025, a total of 14 violations were detected, including 13 administrative violations and 1 criminal prosecution. The total amount collected during the period was over 217.65 million VND.

Comrade Ho Xuan Ninh, Director of the Department of Industry and Trade, Deputy Head of the Standing Committee of the Provincial Steering Committee 389/DP, said: Detecting and controlling violations is very difficult due to the small force, limited means and supporting equipment, not meeting the practical requirements of current inspection and control work. Regarding appraisal work, in order to have a basis for handling, especially criminal handling of the crime of producing counterfeit goods, it is necessary to have an appraisal conclusion on the authenticity and falsity of products whose quality has been declared. However, in the province, there is no center or facility with enough capacity to carry out appraisal work, especially the declared ingredients for products such as food, pharmaceuticals, and fertilizers. Therefore, appraisal work often takes a lot of time, high costs, and the appraisal capacity of some centers and facilities is limited to appraise all the declared ingredients of products that have to be sent to many different appraisal facilities. Legal regulations related to anti-smuggling, trade fraud and counterfeit goods are scattered in many different documents...

To improve solutions to prevent counterfeit goods and goods infringing on intellectual property rights, in the coming time, the Provincial Steering Committee 389/DP will continue to proactively build a coordination mechanism, share information between units, avoid overlap and improve the effectiveness of inspection and control. Deploy peak periods of specialized inspections according to key fields, areas, and subjects at high risk of violations. Direct functional branches to strengthen inspection and examination of high-risk product groups such as cosmetics, functional foods, clothing, footwear, electronic components, pesticides, etc. Organize peak periods of specialized inspections of counterfeit goods and trademark violations in densely populated areas, traditional markets, retail stores, and warehouses. Build and effectively exploit a system to receive and handle feedback on counterfeit goods from people and businesses via apps, hotlines, or websites. Apply barcode and QR code checking software and traceability to identify genuine and fake goods at the time of inspection. Organize extensive propaganda about the harmful effects of counterfeit goods and goods violating intellectual property rights to consumers, especially in rural and remote areas. Continue to grasp the situation and inspect establishments and organizations that show signs of manufacturing and trading goods, especially the following items: Food, cosmetics, fertilizers, and aquatic feed. In particular, focus on products from bird's nest such as: Bird's nest water, stewed bird's nest...

Comrade Ho Xuan Ninh, Director of the Department of Industry and Trade, added: The province also recommended that the National Steering Committee 389 review and complete the legal system related to the fight against smuggling, counterfeit goods, and trade fraud, especially in the field of e-commerce, to ensure consistency, clarity, and suitability with emerging realities. Build a national database of genuine goods, counterfeit goods, and protected trademarks, supporting functional forces in the work of quick comparison and verification. Invest in modern equipment and technology to serve the work of inspection and supervision, especially in tracing electronic transactions and managing data from social networking platforms and e-commerce platforms. Encourage businesses to register for intellectual property protection and implement traceability stamps and QR codes to identify products to increase transparency and prevent counterfeit goods. Organize training and improve the professional skills of officials in identifying and handling newly emerging violations, especially in cyberspace. Strengthening the dissemination of laws to organizations, individuals in production, business and consumers to raise awareness of law compliance and protect consumer rights. The current administrative fines are sometimes too low compared to the profits gained from violations, not enough to deter. It is necessary to increase the fines, especially for large-scale and serious violations.
