National Assembly passes Law on Teachers, not prohibiting teachers from giving extra lessons

On the morning of June 16, the National Assembly officially passed the Law on Teachers. The law takes effect from January 1, 2026.

The Law on Teachers stipulates professional activities, rights and obligations of teachers; titles, professional standards of teachers; recruitment and use of teachers; salary and benefits policies for teachers; training, fostering and international cooperation for teachers; honoring, rewarding and handling violations of teachers; teacher management...

One of the prominent policies of the Law on Teachers is the regulation on salaries and allowances for teachers. Accordingly, Article 23 of the law stipulates that salaries and allowances for teachers in publiceducational institutions clearly stipulate: teachers' salaries are ranked highest in the administrative and career salary scale system; preferential allowances for jobs and other allowances depend on the nature of the job and on the region as prescribed by law.

Preschool teachers; teachers working in ethnic minority areas, mountainous areas, border areas, islands and areas with especially difficult socio -economic conditions; teachers teaching in specialized schools; teachers implementing inclusive education; teachers in some specific fields and occupations are entitled to higher salaries and allowances than teachers working in normal conditions.

The salaries of teachers in non-public educational institutions are implemented according to the provisions of the law on labor. Teachers working in industries and professions with special regimes are entitled to special regimes according to the provisions of the law and are only entitled to the highest level if that policy coincides with the policy for teachers. The Law on Teachers assigns the Government to specify this in detail.

The authority to recruit teachers is stipulated as follows: for public vocational education institutions and public higher education institutions, recruitment is carried out by the head of the educational institution. For non-public educational institutions, recruitment is carried out by the head of the educational institution according to the regulations on organization and operation of the educational institution.

For schools of the people's armed forces, the authority to recruit teachers is prescribed by the Minister of National Defense and the Minister of Public Security...

Thus, regarding recruitment authority, the Government and the National Assembly Standing Committee (NASC) agreed to give the education sector the initiative in recruiting teachers.

Teachers continue to receive seniority allowances until the reform of salary policy for cadres, civil servants, public employees, people's armed forces and employees in enterprises is implemented.

Previously, the report on receiving, explaining and revising the draft Law on Teachers by the National Assembly Standing Committee stated that allowing university lecturers to participate in the management and operation of enterprises is a new policy, which has been thoroughly discussed and has a high level of consensus. However, the expansion of this policy to teachers in vocational education institutions needs to be further studied, evaluated and summarized in practice to have enough basis for consideration and regulation at the appropriate time.

Regarding things that cannot be done, there are suggestions to add regulations prohibiting teachers from giving extra lessons against the law and prohibiting them from giving extra lessons to students that the teacher is directly teaching.

According to the Standing Committee of the National Assembly, the draft law does not prohibit extra teaching, it only stipulates that teachers are not allowed to force students to participate in extra classes in any form to overcome the widespread situation of extra teaching; the requirement that teachers are not allowed to teach extra classes to students they are directly teaching is currently stipulated in the circular on extra teaching and learning of the Ministry of Education and Training.
