Guidance on resolving administrative procedures in the land sector for communes

BAC NINH - On the morning of September 17, at the headquarters of the People's Committee of Yen Phong commune, the Department of Agriculture and Environment of Bac Ninh provided guidance on handling administrative procedures related to land at the commune level when implementing the 2-level local government model for the communes: Yen Phong, Yen Trung, Van Mon, Tam Da, Tam Giang.

Reporting specifically on difficulties and problems in the land sector at the grassroots level, leaders of the People's Committees of the communes said that currently in the work of land acquisition, compensation and support for site clearance, the communes are facing difficulties in calculating compensation and support when the state acquires land with water surface for aquaculture to implement the project; proposing to stipulate additional specific funding to serve the counting of water discharge costs, fish catching costs, fish classification costs, etc.

Compensation for perennial trees and fruit trees is difficult to determine the growing period; it is recommended to support house rental when reclaiming land for urban area projects because currently it only applies when reclaiming residential land to implement urban area projects and other projects do not support this amount.

The current unit price for surveying when performing measurements for site clearance work does not meet actual requirements, many surveying units report losses without performing. How to handle when field inspection detects changes compared to cadastral maps.

In implementing administrative procedures, the VBDLIS software has synchronously integrated administrative procedure sets on the National Public Service Portal and provincial public services. However, the system of newly issued legal documents changes rapidly, and civil servants of the Commune Economic Department have not been updated promptly and fully. In addition, some of the commune-level authorizations on the VBDLIS software are locked, causing difficulties in handling backlog records; there is a lack of support in the process of setting up records for granting Land Use Rights Certificates.

Along with that, there is no specific guidance document on determining the residential land limit and the procedures for auctioning land with built infrastructure (auctioning individual lots); some land plots are used by many households, making it difficult to apply a unified limit...

Propose to soon adjust the land use planning because the two-level government has come into operation, many planning areas of the commune People's Committee headquarters, commune police, and commune center areas are no longer suitable; soon issue guiding documents to unify the 2024 Land Law and Decrees and Circulars to avoid overlap and conflict; consider restoring the commune-level Land Registration Council or issue an alternative coordination mechanism to verify the origin of land...

At the meeting, Deputy Director of the Department of Agriculture and Environment Phi Thanh Binh and representatives of the Ministry of Agriculture and Environment ; departments and units under the Department directly discussed, answered and provided specific instructions for each locality's recommendations and proposals. The focus was on the alternative coordination mechanism to verify land origin; decentralization of the use of VBDLIS software to the commune level; instructions on how to calculate compensation when land is recovered without determining the time of planting perennial trees; re-measurement and correction of cadastral maps; procedures for auctioning land with built infrastructure...

For recommendations and proposals beyond its authority, the Department of Agriculture and Environment will receive, synthesize and report to the provincial leaders for consideration and direction for resolution in the coming time.

The leaders of the Department of Agriculture and Environment requested that the Party Committees and authorities of the communes accept the suggestions and proposed solutions from specialized agencies to remove current difficulties and obstacles. Continue to promote the dissemination of land law regulations so that people can understand and strictly comply with them; regularly train and improve the skills of officials guiding the settlement of land administrative procedures.
