Removing difficulties for commune-level authorities in planning and construction management

After the formation of the new Dak Lak province and the organization of a two-level government model, the commune-level government is facing many difficulties and obstacles in the construction sector. This needs to be resolved soon to meet the needs of infrastructure development and urban and rural beautification in the new period.

Xuan Lanh commune was established on the basis of merging the entire area and population of the two old communes, Xuan Lanh and Da Loc. When switching to a two-level government model from July 1, local activities took place smoothly. However, after the merger, the locality is organizing the implementation according to two separate construction planning projects of the two old communes. This leads to confusion in state management in the field of planning management and construction order, raising the question of whether to establish a new general planning project for the commune or adjust the plans.

Difficulties in managing construction order are also occurring in Hoa Xuan commune due to its large area and small number of civil servants. In addition, some people lack awareness and deliberately build illegal structures. The commune recommends that the province increase human resources to support solving this problem.

In Binh Kien ward, the locality is also concerned about re-planning functional areas and determining the urban core. Mr. Nguyen Quoc Thang, Chairman of Binh Kien ward People's Committee, said: The previous communes and wards of the ward were planned with a supporting role for the center of Tuy Hoa city (old), so it is necessary to rebuild a new plan, suitable for the locality after the merger. Currently, the 1/2000 and 1/500 plans only reach about 15%, many areas in the ward do not have them, so it is very difficult to grant construction permits.

From July 1, 2025, the two-level local government model will officially come into operation. This is also the time when the Law on Urban and Rural Planning and the decrees regulating the delimitation of authority of two-level local governments, decentralization and decentralization in the field of urban and rural planning, and detailing a number of articles of the Law on Urban and Rural Planning will come into effect.

Localities need to review all urban and rural planning projects in the area, identify problems... to develop appropriate adjustment and supplementation plans. The process of reviewing, establishing and adjusting plans needs to pay special attention to analyzing the potential and advantages of the locality, areas, spaces and works that need new planning.

According to the provisions of the law and the above decrees, the state management of urban and rural planning (including the organization of planning, appraisal, approval and management) is strongly decentralized to the commune-level authorities, from general commune planning, zoning planning to detailed planning within the administrative boundaries under their management. This increased decentralization will create favorable conditions for localities to proactively develop planning orientations, manage planning and organize implementation according to the planning.

Mr. Cao Dinh Huy, Director of the Department of Construction, said: "In the immediate period, local authorities will face many difficulties and challenges. The Department of Construction has also completed the Draft Decision on promulgating regulations on decentralization, authorization and procedures in urban and rural planning activities in Dak Lak province, sent for comments and social feedback, and is expected to be submitted for promulgation in October 2025. In particular, the draft content includes decentralization of authority on appraisal and approval of planning tasks and general planning of communes for the People's Committees at the commune level to implement".

"In order to be more proactive in organizing, appraising, and approving planning, meeting investment needs and development management requirements of the locality, the organization of commune-level master planning will be implemented after the above draft regulations are issued by the Provincial People's Committee. Localities need to review all urban and rural planning projects in the area, identify problems... to develop appropriate adjustment and supplementation plans. The process of reviewing, establishing, and adjusting planning needs to pay special attention to analyzing the potential and advantages of the locality, areas, spaces, and works that need new planning and arrangement... From there, choose a reasonable planning solution, ensuring quality and long-term vision, creating a driving force to promote local socio -economic development," Mr. Cao Dinh Huy added.
