People's Jury: The People's Voice in Trials

People's assessors are typical citizens who understand practical life and are elected by the people to participate in trials at the People's Court. The presence of People's assessors ensures democracy in judicial activities and affirms the people's role as masters in the work of the State.

According to the law, when participating in a trial, the People's Jury (HTND) has the same rights as the Judge in evaluating evidence, discussing and deciding on the verdict and decision of the Court. The voice of the HTND therefore has the same legal value as the Judge, clearly reflecting the principle of "people participating in State management and social management".

The role of the People's Court is reflected in many aspects. First of all, they are the bridge between law and life. If the Judge is knowledgeable about the law and has rich professional knowledge, the People's Court possesses rich life and social experience. The combination of legal knowledge and practical life helps the Court's judgments and decisions to be both legal, ethical and popular.

In addition, the participation of the People's Court contributes to enhancing objectivity and transparency in the trial process. They represent the will and aspirations of the people, and are also the "eyes and ears" to monitor judicial activities. Thereby, the people's trust in justice, the strictness and fairness of the law is strengthened.

In practice, many People's Courts have demonstrated responsibility, courage and impartiality when participating in trials. Many of their opinions have contributed significantly to the Court's decision to make reasonable and sympathetic judgments, which have been supported by public opinion. This is a clear demonstration of the effectiveness of the mechanism of people's participation in judicial activities.

During the 2020-2025 period, the People's Courts at two levels in Thai Nguyen province accepted more than 45,000 cases and resolved nearly 44,000 cases, reaching an overall rate of 96%. The rate of resolving all types of cases exceeded the target assigned by the National Assembly, with criminal cases reaching 99%, civil and other cases reaching 95.5%, and administrative cases reaching 95.4%. The application of administrative handling measures was also carried out in accordance with regulations.

Currently, the province has nearly 300 People's Courts accompanying Judges in 100% of trial activities. The participation of People's Courts contributes to improving the quality of case resolution, ensuring objectivity and fairness. Every year, the Provincial People's Court organizes training courses, fosters trial skills, guides the application and updates of new legal documents, and exchanges practical experiences to improve the professional skills of the People's Court team.

Ms. Pham Ngoc Linh, Judge of the People's Court of Region 1, Thai Nguyen Province, said: The participation of the People's Council is an important factor in ensuring democracy in trials. In some trials, the opinions of the People's Council helped us to make reasonable judgments.

In fact, to maximize the role of the People's Court, special attention should be paid to fostering legal knowledge and trial skills for this team. In the context of international integration and rapid development of social life, the nature and complexity of cases are increasing, requiring the People's Court to not only rely on life experience but also have a good understanding of the law and litigation procedures.

It can be affirmed that the People's Court is an important institution, clearly reflecting the democracy in the organization and operation of the People's Court. Their participation in the trial not only demonstrates the people's mastery but also contributes to ensuring that justice is implemented in a fair, transparent and humane manner.
